No, that is a consequence. No one gets sentenced to a dog bite to the face as a penalty for trespassing.
The kid will probably learn a good lesson, but it the Mom wants to be a bitch about this, she has a claim. It’s not hard to put a dog behind a real fence.

Baw, Do you really think the dog bit the kid because he was trespassing? OP clearly said he was abusing the dog by picking it up by its feet. In his own yard, hundreds of yards from the kid's house, after being told to leave the dog alone?

Dear parents: Please teach your kids, at a young age, how to handle animals. Dogs, for example, are not stuffed animals. If you kid goes up to the dog and pulls on the dog's tail or tries to pick it up, etc... If the dog feels like he/she is in harms way or doesn't feel safe, he/she is likely able to defend itself.. By biting.
I don't let my dogs run around in the front yard just because I don't know what other people will try to do to them, but they have more than enough yard in the back to chase squirrels, birds, etc.

Had a friend who had to get rid of a beagle, because of a similar situation. His insurance was going to drop him, if he didn't get rid of it. Same situation as yours, where the neighborhood kids climbed over his fence. He put up signs, printed up flyers, and handed them out after the first kid got bitten. It happened on three occasions. Twice with one stupid kid. I was surprised when he had to get rid of it.
