Yea, he always casually puts a gun in his waistband whenever he goes outside to talk to people hanging with his daughter.
He didn't put that there and then tell the kid to get off his daughter to scare the shite out of him at all!

We are discussing theory here. Any crime must be proven beyond a reasonable doubt. As such, "eye gestures" are going to be very tough to prove.

And it must be proven beyond a reasonable doubt.
The criminal threat is very tough for me to see here without a lot more info.
Plus we have a police officer's learned opinion on the situation where he states that he would not bother to make an arrest in this situation.

I was cleaning it when I saw the car down the street. I decided to investigate it since we've had a few thefts in the area lately. This is so easy that I could be his defense attorney

Screw all y'all for down voting what the BIL did. Till you have a daughter, y'all don't know shite. 
My self, at that age my daughter had a date on New Years eve at my house. The young man dating my daughter, I did take the time with him for a walk down the road. Flat out told him if he frick up with my daughter, I would plant his arse were no man ever walked before.
5 years later, they got married. The rehearsal dinner, that is when I found out that he went home that New Years night and told his Dad and Grandpaw what I told him. Guess what? They agreed on what I told my SIL.
They been married 11 years now.

Used to date a girl in HS, first time i picked her up her pop came to meet me with an axe in his hand. Said he was renovating (which he was but didnt need to carry the axe)
He stressed the importance of having his daughter home on time, message recieved, we were always on time.
Except once when i had a flat and he came outside with a .22. Saod he thought we were already home and was investigating a noise outside.
Message recieved.
