Not if you are a cop I guess.

Yeah frick that bitch arse cop. Yeah she was being a bitch but the cop didn't handle that situation well at all. He was just a prick on a power trip.
And as someone else said since when do you have to decide on the spot if youre going to pay the ticket or go to court. Normally you sign with no admission of guilt then decide after the fact whether you want to pay or go to court.

Cop seemed like a dick...and why did she have to make a decision on whether to pay or contest on the spot? is that normal?

Is there a law requiring you to roll your window all the way down when given a ticket
It's considered a lawful order and is minimally intrusive. The USSC ruled in Penn. v Mims that an officer can order a driver to open doors, exit the vehicle, or stay in the vehicle. In the ruling of Maryland v Wilson those orders were extended to include passengers as well. Pretty widely accepted that this would include having drivers to raise or lower windows drivers and others as well and has been upheld in lower courts using the referenced cases as precedent. So while no stated law that I am aware says a driver has to lower the window x amount when instructed, failing to follow a minimally intrusive instruction by an officer would and could easily be argued as a misdemeanor for failing to follow a lawful order.
Cop failed to deescalate, and this woman appears to be a royal see you next Tuesday as evidenced by her husband's reaction. He needs more training or a new occupation if he can't handle the public at their best and worst. She needs to be slapped by reality that the world does not revolve around her, nor does the sun shine it's light for her alone.

One question: if a cop tossed a pen at a citizen, is that assault and how likely are they to be charged?
Probably not. Their union and other cops would protect them and the DA would likely drop or reduce any attempt to change. They have tons of protections behind the thin blue line. Their protected status is why cops should be held to a much higher standard than the general public

It does not seem so to me.
She should be able just to refuse to sign. It is a summons, so you can refuse and just appear in court in response.
Also, how can you make that decision if you don’t know what the fine is? You might. Say eff it if it is $25 bucks, but fight it if it is $500 with possible license suspension.

Justifying assault on a police officer?
Justifying a cop escalating a situation with kids involved?

No he didn't
That's absolutely bullshite. His exact words were "In a minute I'm going to arrest you and take the kids".
Not "if I have to" or "if you don't ____".
He said in a minute " I'm going to do this".
That is 100% escalation without any attempt to de escalate.

You don't watch many of these videos do you? You haven't seen all the human shite cops have to deal with all the time huh?
This exact response is whats wrong with the situation. Cops have to be able to differentiate and control their emotions. They are not supposed to treat a mom with children in the car the same way they would a career felon.
If you can't handle different situations with different approaches then you do not need to be a cop.
The last thing we need is a bunch of cops that view the average citizen as a dangerous felon.
The cop threatened her kids because he got his ego hurt after she gave him attitude. That's ridiculous.

life sucks and then you die. she got a speeding ticket. fight it in court-which she won't win even if she says it was a speed trap and the officer had a quota- or pay the fine.
in the meantime, those 3 babies with one sick were in the car watching and scared- while she threw the pen like a brat.
who raised the Karen that she is an immature brat?

But she didn’t spit at him. I’ll go on record and say that had the cop tossed something at her (pen/paper/etc) in a similar manner he would not ever be charged with assault.
Good thing he didn't toss anything at her.

That woman is one of the worst I've ever seen. WTF is wrong with her? She has an attitude and is sarcastic the entire time.
I've seen plenty of women like her working in schools. Never underestimate the entitlement of a mediocre looking American white woman who has kids.

How did he escalate the situation? You think he escalated it when he she wouldn't roll the window down and he said he wasn't playing the stupid games. I bet that's what you think.

Yep, that's called a warning. Act right. Don't throw pens. I've seen a thousand cops say that on a thousand cop cam videos. He told her to act right and be professional multiple times before that. Try again.

I think the cop handled the situation fine. Don't be a bitch and throw pens at officers.

No that is not a warning, its a threat. I just explained the difference several times unless you aren't capable of reading. He did not say "if you don't". He said "in a minute I'm going to". You have to say one of those before the other in order for it to be a warning.

Don't be a bitch
Is exactly what the officer should be told. His response had a direct correlation to her rolling the window up on him. He got in his feelings. If kids are involved the cop has to keep himself in check otherwise he is purposely choosing to put kids in danger and this was not a dangerous felon. Its excessive.
Who was he protecting when he threatened to take her kids away because she rolled a window up on him? The answer is his ego. If a cop can't choose the safety/ well being of children > his ego then that's pretty bad.
I don't care about the mom or her repercussions. The fact is that children are involved and the cop chose to escalate in that situation. He's a POS. You really want to argue choosing to escalate with kids involved? Go ahead, but that's pathetic.

They’re both in the wrong. Total overreaction by the cop but the lady was being a giant count too.

The interjections from the narrator of that channel are annoying.
There are far superior body-cam channels without that nonsense.
