Louisiana revokes permit of defiant BBQ restaurant for refusing to require masks

Louisiana has taken its first serious enforcement action on a restaurant for violating Gov. John Bel Edwards' coronavirus rules regarding masks, revoking the food permit of a defiant Denham Springs BBQ restaurant after its owner refused to require masks for employees or customers.
Health Department spokeswoman Aly Neel said the agency revoked the restaurant's food permit after repeated efforts to get the business to comply with mask and social distancing rules in recent days.
LDH sent a sanitarian to inspect the restaurant after the state received multiple complaints. After handing the owner a report -- which included violations of masking for employees and customers, as well as tables not spaced out properly -- the owner refused to make changes.
Records show the restaurant is owned by James "Darren" Browning, of Denham Springs. When reached by phone Saturday, an employee of the restaurant declined to comment or connect a reporter with the owner.
In a Facebook post pinned to the restaurant's profile, the owner writes that masks are not required, and claims that they have "caused several medical reactions" to employees.

In another Facebook post on Saturday, the business wrote that "despite the attempted enforcement of an illegal mandate, we are conducting business as usual," with an image of a cartoon character and the words "yes, we're open." The post encouraged patrons to "show your support" by patronizing the restaurant to help pay for an attorney "that will be fighting for your rights and ours as citizens."

Which law is that exactly?

But it's not a law technically speaking

they basically begged the guy to comply and he made it clear he had no interest in following the rules. If you don't like the law, you have the option of fighting it in court. But you can't just say "ya know what, this law bothers me so I'll just ignore it- what are you gonna do about it?" When you do that, well, now he knows what they're gonna do about it.
Except it is not a law its a mandate and likely unenforceable.

bullshite
They stated on social media that they were not enforcing employees wearing masks due to working in a hot kitchen & some were uncomfortable
They also stated it was a customers choice
They had tables spaced per guidelines

According to the order, Firehouse BBQ faced a random inspection from a health official "sometime next week" and, if not in compliance with the following rules, the restaurant would remain closed.
quote:
Those rules are:
To immediately and permanently remove any signs at the Facility, and posts on social media, stating or indicating that compliance with the mask/face covering requirements of the Governor's COVID-19 related Proclamations do not have to be adhered to at the Facility or customers/patrons;
To not replace any such removed signs with substantially similar substitutes;
To enforce the applicable mask/face covering requires of the Governor's COVID-19-related Proclamations at the Facility at all time by ejecting from the Facility any employees or customers who fail or refuse to wear masks/face coverings as required by such Proclamations;
To maintain and enforce the applicable table distancing and social distancing requirements of the Governor's COVID-19-related Proclamations at the Facility at all times, including by ejections of customers/patrons who fail or refuse to adhere to same.

Tables were spaced out per FB
State is going after businesses that speak out
Here is a pic of L’auberge last night per FB

I don’t care what side of the mask debate you are on, wearing a mask to walk to a table just to sit down & take it off in a restaurant is stupid & serves no purpose

So now the State is denying people the ability to practice Capitalism and denying their ability to work or own a business.
All people should simply ignore the State requirements for licensing and registration of their businesses from now on.

Livingston Parish said they aren’t enforcing the mask mandate.

Agree 100%.
Sadly I fear this is the only way things will ever get back to normal. Once government makes this kind of overreach with indefinite timelines and moving goalposts it is going to drag out who knows how long if we leave it in the hands of our dim-witted governor.

Are health code requirement legislative of administrative?

I hope he sues. Along with other business owners.
Also, I don't know anyone that has gotten Corona that didn't wear a mask. That's all I'm gonna say.
