Jackpot justice. There is a reason why the ghettos of this state are plastered with personal injury advertising. Buddy of mine clerked for a PI atty in NOLA. The stories he would tell are both hilarious and sad at the same time. Having to go to the ghetto to pick up clients to bring them to the chiropractor, them making him stop at popeyes and other places to buy them food and other bullshite, the cash advances, etc. Repeat clients would ask for cash advances right up front in intake. If they refused, the client would take to another firm. Another PI atty friend told me that in his estimation, less than 30% of his PI clients were medically legit. Everything else was a sliding scale of bullshite.

And none seem particularly hurt...which is hilarious because I am certain their attorneys got a doctor to say they were going to need $$$$$$ in future medical treatment for the rest of their lives. Of course, everything gets better once the green poultice is applied.

Anyone have an opinion on the collateral source rule revision in the Bill?
Also, what about imposing requirements for future medical awards? Maybe requiring placement of a future medical award into a trust and requiring that it be entirely spent on the life care plan submitted by the Plaintiff?

Personal injury ads are out of control.
It's like 75% of all local ads.
So many see accidents without injury as paychecks. Sure when doctors are involved and bills aren't paid, then sue. I don't see the need to sue because of a love tap. Though if you sue, they almost always settle.
So with no injury you'll get $7500 if they have minimums. *
*(source) I know a lot of people who have gone this route. Even let a friend borrow my car someone hit him. He wasn't hurt. I got more than cars value from insurance, he got $11k from his lawyer.

I see both sides of the argument, however the windfall for plaintiffs and their attorneys to assert what amounts to false medical bills that they do not have to pay is absurd.

Yep right wing wealth redistributionists blame it all on the lawyers. Lord help an insurance company actually have to pay for the injuries their customers cause.
Meanwhile, who needs better roads and other infrastructure improvements, when there are more chemical plants that need taxpayer subsidies.

It absolutely does, as well as fraud and a few other factors. But a large part of it is the legal system. We get some changes done that make it a more profitable climate for Insurance Co's we'd see and influx of several new Auto carriers. More carries... more competition...Better rates...

The only problem with the ”windfall” argument for collateral source is the assumption that all medical insurance plans are the same and they are not. Not all health plans pay out the same.
So, if I’m injured and I was not at fault in the accident. Why should the other party get off easier because I have a great heath plan that pays for everything? So, I would get penalized for paying a higher insurance premium and having a better health plan. The at fault party’s insurance doesn’t have to pay me as much for my med bills cause my premium picked up the tab.
I don’t presume to know what the real fix would be, but I would take issue with that.

As an aside, LA supremes today ruled that when worker's comp pays meds in a third-party tort suit, plaintiff can only recover what was paid pursuant to the comp fee schedule.

LABI got greedy. Shoulda gone lower threshold for longer prescription with increased funding to judiciary to facilitate more juries. Show us that leads to substantive and long-term decrease in rates then come back for more.
They got greedy with the collateral source and tried to rush it through without enough input from all affected parties.
That’s not even getting into the transparency of seeing how much money insurance companies are profiting or losing in Louisiana.

Ask the medical malpractice insurers who pushed for "reform" years ago. They got what they wanted and premiums didn't go down but profits skyrocketed.
If consumers think the profits will be passed on to consumers in the form of lower premiums, I have a lovely bridge over Lake Ponchartrain to sell you.

In my mind, someone who thinks they should elect "One of their on" over a someone who may be a more qualified candidate, is more of what's wrong with Louisiana politics.
