If you want to fight it id get a decent lawyer.
If you are just going to 894 then paying for a lawyer will be a waste of money.

Don't throw your money away on him for this 1st one. A damn public pretender can file a pre trial intervention request. Go to a MADD class, another bs class, and community service and you are good

Before the teetotalers, gays and blue hairs took over the OT there were some great drunk driving discussions, but now I think you will get destroyed.

Should be an attempted murder charge.
Ditto for people on their phone since they cause more accidents.

This is a serious offense- as it should be! In what absurd world do you live that someone suggested that they shouldn't hire an attorney?

Yep, bunch of assholes acting like they never got behind the wheel after drinking.
There are plenty of people who have not. Growing up in south Louisiana probably means you know fewer, but they have them even here. Not you or I , I assume, but I am smart enough to know and admit if I had gotten an OWI it would have been only my fault and that it was stupid and trashy even though I did not get caught.

You only need an attorney if you are gonna fight it.
He will be able to get an article 894 without paying an attorney a few thousand bucks on top

Find attorney that specializes in DUI. Too much to risk to be messing around without knowing what they’re doing.

Should be in jail for a while. That is reckless behavior with people's lives

It’s amazing how many people can’t answer simple questions on this site

If you just want to get the first offender deal where you ultimately end up with a "set aside" DUI conviction that most people can't see, then you probably don't need a lawyer. Just ask the DA to do it that way and tell him you'll plead to it if he does. You might want to pay an attorney a small fee to file the motion to set aside after you complete your probation, but you don't need an attorney up front.
If you want to fight the charge (and I certainly would), then get a lawyer who really specializes in DUI. This is not a lawyer who'll look at your case and tell you, "I think I can get you the first-time offender deal." That's bogus. You want a guy who's going to challenge every aspect of the prosecution's case, from jurisdiction to probable cause and even the accuracy of the relevant calibration certificates. If that doesn't work, he'll just run the clock down until one of the witnesses relocates out-of-state or something.
Those lawyers are expensive, but they have a surprisingly high success rate avoiding DUI convictions. When they don't, hey- at least they've kept the cops inside a courtroom for a few hours instead of harassing other motorists.

Thank you for all of this info. and replies. I do agree that this was a very selfish and stupid act on his part. This wasn’t me, though even if it was I would have come here first for your advice. I’m just trying to help someone out with bc they are young. He knows he was wrong and says he is learning his lesson. Looks like I am going to tell him to get an attorney which sounds like the majority of people agree with.
