That Texas law has never sat right with me. First, what is "night" exactly, and why does it matter?

Beyond that, I don't think the people who pass such a law realize how wide-open it is. They're thinking of cattle rustlers and whatnot, but the people actually exercising the right are just as likely to be Reddit neckbeards protecting $1,200 fart-canned Hondas. (True story.)

Cannot use deadly force in the defense of property.


If they are attempting to enter the home with you inside then you can defend your home.

Because you're still going to face at least some legal ramifications. Could be almost nothing, could out you in prison for a very long time.

And that's nothing to say about the mental consequences that come from killing someone. It's not glamorous. That stuff can haunt people for the rest of their lives.

It's just extremely high risk/zero reward for shooting someone over a gas can. Or even a car. Opening yourself up to the judicial system is not smart in this country.

No, but I also dont want a bloody trail from dragging a body that the technicians will notice immediately when they look over the scene.

He was charging and then continued to crawl after being shot trying to get into the house, where you finished the job

That is why if you can. You put yourself between them and their only means of escape. When they try to escape you can implement justice and tell the popo they were charging at you and you feared for your life.

That “property” you’re protecting is going to cost you a fortune by the time you’re finished paying for your defense.

I assume you are being glib but if not that is the worst advice in this thread. Don't EVER move a body you have shot at most remove their weapon if they have one and try to not touch it in the process. Moving of the body can give rise to the suspicion of mens rea on your part and make the make life a lot worse for you.

Eh that's a catchy little phrase but I would argue that the worst way your life could change is if the perp breaks into your house and kills you or a family member because you didn't do anything.

That is correct but you have to choose the lesser of two evils. Losing a family member is worth spending your life savings defending your actions in court when Dindu Nuffins mama sues you for killing her baby. It's not worth it to save your ATV or your pickup truck.
