I like how somehow being mentally not there absolves you from the heinous act you committed. Not fit to go on trial and be punished, but fit enough to be a member of society and to take part in society and then commit an egregious crime.

If you’re incompetent to stand trial you are incompetent to walk around freely before you kill someone also.

So he just stays in a mental hospital jail and not a regular jail?

Can we just let him plead guilty and stay in a mental hospital jail and quit taking up the court's time? Seems like a win win.

As always, incompetent means they are currently unable to understand the proceedings against them and/or are unable to assist in their own defense. This simply pauses the proceedings until such time he is deemed restored to competency, then the prosecution can move forward.

This is utterly unrelated to a finding of insanity at the time of the offense, meaning he couldn’t discern right from wrong at the time of the offense, which would mean he could enter a not guilty by reason of insanity plea.

In fact, one can’t even be evaluated for sanity unless/until one is deemed competent.
