From a common sense standpoint it seems stupid. Explain his danger to society bot now, and at the actual time of the incident?

Just stating the law as to how he was charged, tried, and convicted of a murder. Never said I agree with the verdict/plea or the sentencing.

Pretty sure you're fricked if someone dies in the process of you committing a felony like buying drugs.

Yep. It's called 2nd degree murder.

By what you said if I'm going to buy 2 grams of weed and the dealer is walking across the street to bring it to me and gets run over by a car and dies, then Im going to get life because he died while I was buying drugs which according to you is a felony.

You know exactly what he meant, obviously your imagined situation doesn't fall into the discussion. Not sure why you felt the need to type all of that out

I believe all of that, and I hope he gets clemency. But the web site suggests that he just got in the wrong car and bad things happened. That's bullshite.

I don't doubt that he made a bad decision as a young man. I believe that sentencing laws are far too rigid. But let's not pretend this was just an instantaneous bad decision. He plainly decided to participate in armed robbery. That alone could have gotten him ninety-nine years even if no one had been killed.

The evidence adduced at the petitioner's trial reflects that on September 15, 2001, the victim, Luke Villar, was an employee at DeLaune's Supermarket in Gonzales, Louisiana, and was sweeping the sidewalk and parking lot in front of the supermarket at around 5:30 a.m. when he was approached by two individuals. These individuals were armed with guns later identified as being a 30-30 rifle with a scope and a .20 gauge shotgun. The person armed with the 30-30 rifle shot the victim twice in the back and then walked into the store and fired through a counter where another employee, Angelina Weber, was attempting to hide. Luke Villar was killed and Ms. Weber was wounded as a result of this encounter.

Three individuals were arrested the day following the offense, Justin Granier, Joshua Barrow, and the petitioner. The ensuing investigation disclosed that Granier, Barrow and the petitioner had been together at two parties during the evening preceding the murder and that Granier and Barrow had been observed in possession of firearms that they had placed in the trunk of Barrow's girlfriend's vehicle. Several witnesses testified that they observed Granier, Barrow and the petitioner leaving the second party together in the referenced vehicle prior to the murder. A fourth participant in the events of the referenced evening, Nicholas Babin, was the owner of the shotgun allegedly utilized during the incident, had obtained and given the shotgun to Barrow during the evening at Granier's request, and had assisted in disposing of the firearms after the shooting.

quote:

Joshua Barrow testified at trial that he was at the two parties during the night preceding the murder and, at the request of Justin Granier, had gone with Nicholas Babin to Babin's residence to obtain a shotgun. Later on the same evening, sometime around 4:00 or 4:30 a.m., Joshua Barrow gave Justin Granier and the petitioner a ride to a friend's house. Upon leaving the friend's house, as they passed DeLaune's Supermarket, one of the passengers, believed to be the petitioner, yelled "stop the car," which Barrow did. Tr. R. at p. 1250. Granier and the petitioner then jumped out of the car, with the petitioner armed with a rifle and with Granier armed with a shotgun. Id. As Barrow then waited in the vehicle, he heard some shots and, shortly thereafter, Granier and the petitioner returned to the vehicle. According to Barrow, after the petitioner returned to the vehicle, he "dapped" fists with Barrow and Granier and made a statement, asserting "I really did it." Id. at p. 1251-52.

I don't think that is right.

"2) When the offender is engaged in the perpetration or attempted perpetration of aggravated or first degree rape, forcible or second degree rape, aggravated arson, aggravated burglary, aggravated kidnapping, second degree kidnapping, aggravated escape, assault by drive-by shooting, armed robbery, first degree robbery, second degree robbery, simple robbery, cruelty to juveniles, second degree cruelty to juveniles, or terrorism, even though he has no intent to kill or to inflict great bodily harm."

I don't think buying drugs sets up felony murder under Louisiana law.

The unfortunate part in this he has to live with it? Not the fact that someone died?

Justin made a thoughtless choice to take some so called friends to score drugs.

This is the big red flag here.

Trying to get drugs by itself won't get a life term. But if you like to hang around people who think this is normal, then you raise the chance that you'll into much more rough shite than you bargained for.

Dude Andrew I've been knowing for forever is in jail for life with his gf who was in the car who was 18 as well for something sorta similar. They drove to someone's apt to get some pills and the guy who was with them ended up shooting the girl. The fricked up part is they set the apt complex on fire to try and cover it up after the fact.

No way this dude would have been capable to do something like this. He was actually pretty loaded and never had a reason to rob anyone but frick around with the frick arounds and frick around and get fricked around.

I mean he's a smack addict with thug criminal friends. It's sucks that he's in jail, but he was involved in the felony drug deal and accomplice to murder.

Hang around dogs, get fleas, etc...
