Why? OP was put in a difficult situation by a doofus who rear ended him. If OP experienced pain and suffering due to said doofus, he can make a bodily injury claim against said doofus’ insurance carrier and can use the funds to help alleviate the difficult situation the doofus put him in.

The car only has 70,000 miles on it. It's loaded with leather seats, back up camera, turbocharged, 6 speed automatic and it's clean and was without a scratch. I don't see a scenario where I walk away with a better car.

In the most non OT away possible, you aren’t supposed to walk away with a better car. You’re supposed to get what your car is worth.

Thank you. I've heard that they're very fair. I'm going to find out tomorrow morning. The adjuster is supposed to stop by.

I just don't know. I certainly shouldn't be forced to walking status because of someone's negligence on the road. My property has been destroyed through no fault of my own.

What I'm saying is that I don't think that I'll walk away with anything at all close to the car that I had. I'll have to get a much worse car.

I agree with that but you can’t change what happened. So looking forward, what is fair?
