So what is the deal? If he doesn’t keep it, the bank values it at $10k, pays off his $9k balance, then gives him $1k. But if he keeps it, they give him $8k and he’s stuck still paying the bank?

(Hypothetical numbers. Trying to understand.)

If your neck was sore due to the accident, even for just a few days, or you had some other injury, however minor, make a bodily injury claim against the at fault party. Don’t settle for less than $5,000 at minimum. If you’re a little patient and persistent, you should be able to get $10k minimum. Don’t start there though. Make your initial demand at least twice as much as where you want to end up.

Yea so let’s say insurance offers him 10k. They essentially buy the vehicle in its pre loss condition. If he keeps it, it will be less the salvage bid (what’s it’s worth in its current condition) which maybe 3-4K for a 10k vehicle. So if he keeps it settlement would be around 6-7k which isn’t enough to pay the bank off which is why they won’t sign off on it

Most companies will send someone out to write an estimate. If the estimate totals the car, they’ll run a market survey/evaluation. The report will usually find what other cars like yours are selling for within a certain area and determine the market value of your car. TT&L should be added and that’s what they’ll offer you.

What you owe on the car is not considered in the payoff (nor should it be). They give you the amount that the car is worth.

Situation truly sucks. While your car may not have been worth much by actuary standards, it was keeping you from having to finance a new vehicle at cost to you.
