The minute you drive a car off the lot, it depreciates in value.

The lady at the collision center said that the car will probably be totaled. She said my car is worth about a thousand more than I owe on it.

So no insurance company has been asked anything yet?

If you have collision coverage, and you probably do since you are financed, I've twice have good luck filing with my State Farm collision coverage when an at-fault damaged our cars. They approved repairs right away, then they duked it out with the at fault driver's liability insurer. When they collected, they sent me a $500 check for the deductible I ate on the collision claim. Lots less PITA for me than haggling with some other insurance company.

Your mileage may vary.

I did the claim through mine. They went after the guys company after. So I was able to get a new vehicle with the 10k Geico gave me. I had to pay deductible though. Once they got their money from the other guys company, got my deductible back.

But the process sucked. I actually had to go to the police station to get the reports and send them in. The lady I was dealing with from the other insurance company would just ignore my calls or hang up on me.

I'm dealing with the other insurance company. They've been helpful so far. The adjuster is supposed to be here this morning.

No he isn’t giving legal advise. Not even close

Another thing to consider is that in your situation as the “middle vehicle” you could be partially responsible for the vehicle you hit in the back.

So far that hasn't been an issue but I have full coverage so I'm not going to worry too much about it.

I just don't know. I certainly shouldn't be forced to walking status because of someone's negligence on the road. My property has been destroyed through no fault of my own.

Completely agree with all of your assessments of the situation thus far.
People, it's not like he's wanting his insurance company to make him whole again.

He deserves to be made whole by the at fault partys insurance company. And that's not including pain and suffering he may have from the incident.
