The valuation should have other 2015 Chevy Sonics that are for sale and where they are listed, you could start there.
I also realize that you’re not going to be getting into a car who’s history you know from purchase to present day.

The same situation your in I was in. I took my $1000. I bought a pos. I saved $500 a month for two years. After two years another guy hit me from behind. I had $12 grand cash saved. I got another grand for the second crash. I take that money and I buy a Ford pick up truck.

I agree with that but you can’t change what happened. So looking forward, what is fair
I think at a minimum I shouldn't have to downgrade and have my car replaced with a comparable car. To me that's fair.

An insurance company is not concerned with what’s fair. They’re concerned with what they’re contractually obligated to do- no more, no less.

on THE CAR ALONE you should get NADA retail plus TTL
After looking at what I owe vs the payoff it may turn out that I get a pretty substantial amount. Add in TTL and I might not be in as bad of shape as I thought.

accept nothing less. - If you were rear ended and car totaled you should really get an attorney to handle this.

Yeah. I understand, it just gripes me that we almost had the car paid off and now somebody else put us in a bind. I'm not in any shape to deal with this stuff right now.

Attorney does not care about his totaled car. They don’t make any money for a vehicle someone is already upside down on.

Not trying to be an arse, but if this puts you in a bind financially, you probably bought too much car to begin with. Buy a beater with cash from the check and save some money. Google Dave Ramsey.

The first thing you do is go to the emergency room Next, call Gordon and get set up with a chiropractor.
Repeat step two weekly... get paid

Actually I was being frugal when I bought the car. We could've bought a car worth 2 or 3 times what that car was worth with no problem. Something catastrophic happened last year that has ruined us financially and has me making a fraction of what I used to make. That's why this accident happening at this time is hitting us so bad.

Unfortunately, unless you are injured it is all about property, not what’s fair. I’ve been totaled out twice in the last seven years by another party. I had to come out of pocket both times. I’m very lucky to be here, so I let that be my solace. Wishing you well through the process.

Make sure you tell them about your pain and anguish caused from the wreck. They owe you payment for that on top of the value of your totaled vehicle. But they won’t tell you that, you have to request it.

Iirc you are battling pancreatic cancer. . Terrible that this car problem is adding even more emotional and financial stress. Wishing you the best of outcomes with both.

You should get KBB retail for your car. If not, do like the scumbags do and find an ailment, if you know what I mean

Were you the vehicle rear ended by a white Tahoe as y’all were on Essen Lane exit ramp? I saw the accident as it happened. If that was you, you got tagged. Hope you’re doing okay.

Yes that was me. I'm afraid that the Tahoe is totaled. The accident actually hurt like hell.
She never hit the brakes.

Ins offers you 10K for your car. You say frick that I'm getting an Atty. 90-120 days later if your lucky the Atty gets them up to 12K. Atty takes his 1/3 and you get your 8K for the car

This just doesn't seem fair
In the grand scheme, it isn't. Perceived screwing on PD claims is one of the biggest motivators for filing tenuous PI claims.
If you break it down in every aspect the claimant almost always loses in a PD claim.
