Incorrect. The ring is not payment for a contract to marry. It is future good promised once a contract is fulfilled. She never gets to keep the engagement ring without marriage. No matter who breaks it up, because it is unjust enrichment, and the court cannot order or mandate a wedding to fulfill the contract, therefore once the contract is broken the ring goes back.
If they get married however, then she always gets the engagement ring.

It varies by state as to whether it is a gift that does not have to be returned or a conditional gift that has to be returned. Some courts have looked at who was at fault for the break up in determining who keeps the ring.

Now her current bf just said he needs "space" and moved out. They still see each other but don't sleep together and he recently set her up with one of his friends. Makes me glad I'm not single anymore
