No one is arguing legality of abolishing slavery. It was done via the correct process: Constitutional Amendment. The Emancipation Proclamation only abolished slavery in states in rebellion that the Union army wasn't occupying (i.e. was not actually enforceable).
The issue was whether the 10th Amendment rights and powers reserved to the states included secession.

Who do you think would’ve won that? I can’t speak for Madison, but everything I’ve ever heard or read about Lincoln was that he was a great debater.
