illegality of secession and suspension of habeus corpus, jailing of dissidents, marshal law in Maryland, etc. argued by Lincoln verses the guy who actually wrote the Constitution. Lincoln did a lot of things as commander in chief that were probably unconstitutional, but Lincoln justified them as the product of necessity. It would be great to find out if Lincoln's actions really were intended to be allowed by the framer's of the COnsitution or if he had, in fact, taken significant liberties.
For example, Ex-Parte Merryman, The SCOTUS rules against Lincoln's suspension of habeus corpus and demands Lincoln release a political prisoner (a northern journalist critical of the war effort). Lincoln replied to that ruling by telling SCOTUS to pound sand.
