I’m currently a defendant with someone claiming to be a member of a corporation with me, and looking to access a piece of property I lease. He ain’t part of the non profit, never has been, never been told he was by me. Hunting lease bullshite, I asked him to move on and he’s claiming to be part of the corp listed as the lease holder. OT lawyers, what’s my chances here? Talking to counsel next week.
What are your lawsuit stories?

Douche bags on our hunting lease wouldn’t take their clapped out trucks so I used it for target practice and tannerite fun. They got butt hurt over that and first tried to blackmail me, then filed a lawsuit, and it all ended when we termed their lease and burned all their shite.

Got a call from an employee saying she was in jail. DWI. I bailed her out (and got her vehicle out of impound). While we were about to pull out from the courthouse/jail, I got bumped by a commercial vehicle (fender bender at most). She was in my passenger seat at the time. She ended up suing me and the commercial driver. I fired her and pushed thru the checks (knowing they would bounce) that she had given me for reimbursement for bail.

Why would you bail someone like this out in the first place?

Obviously you don’t run a small business. It’s a business decision.

I have a deposition on Monday. Fat black woman claiming a trip and fall on property we were working on. I hate people.
this is the second time. The first time my answers were “no” and “I don’t recall”. Should be short and similar

Yes, she was a good worker for the over night shift.
ETA: she had written me 4 checks for $200 each and I was going to space out over 4 months. Until I got sued. She said she injured her back. POS.

I get it. People / staffing is the hardest part. And it’s not even close.

Unfortunately she reminded you why she was working an overnight and likely couldn’t hold a good regular job.
I’ve never been sued. One of my employees on lunch break (praise the lord) went to pick up his lunch and a guy on an electric scooter threw the scooter under his car at a cross walk, guy was fine. Went to the hospital and got over $10k from the insurance company.

Just out of grad school I was part (small part) of a company that went tits up. We were all initially named in a $55MM lawsuit. My name was removed but for a few weeks I was wondering wtf I was going to do.

Real answer is, this kind of litigation is often more about who has the wherewithal to keep cutting checks to their attorneys and who runs out of money first than about what the law says. It is possible that this jackass thinks you will get tired of writing $5,000 checks to your attorney every month and you’ll give up and give him what he wants. He might be right. Keep that in mind when you talk to your lawyer and good luck.

Something somewhat similar happened to my dad. This was in the 80s, I was a kid, but my grandmother (his mom) lived next to my dad's sister. He went visit his mom and my aunt saw he was there and went ask him if he would bring her maid home. He agreed. Went bring her home, non eventful.. So he thought. Months later he received something in the mail informing him his insurance rates were going up and separate letter explaining his insurance had been sued.
When he called his insurance they informed him that the maid claimed that when she got out of his truck she tripped on something in the truck, fell down and injured her ankle and arm. My daddy said that woman didn't even almost trip. They didn't even call to get his side of the story, which was there was she got out of his truck with no complications at all.
He found out that it wasn't the woman's first time suing someone's insurance. I don't know the details on this, but she knew how to work the system.

I found out later that she bragged that she got $10k from the truck company (very big distributor of sodas). She would even come around trying to talk to some of the staff. I was like, get the f out of here!

Is this alleged “corporation” a true corporation (with stockholders) or a limited liability company(“members” instead of “stockholders”)
Are either registered with the Secretary of State’s office?
Does the company have bylaws or an operating agreement and a list of stockholders/members?
How much $ did the plaintiff buy into the company for?
Whose name is the lease in? Yours or the company’s ?
If the lease is in your name individually, is there a written document showing the hunting club has permission to use the property?

Hit and run. I was young and dumb and side swiped somebody while drunk and took off and they got my plate. Got a letter in the mail awhile later. Lucky they didn’t come arrest my arse. My insurance is still sky high to this day over it tho
