Germany demotes possession of child s*xual abuse images to misdemeanor

Downgraded from felony to misdemeanor and minimum sentence is now just 3 months. This is disgusting.

It states that the possession and acquisition of child pornography will in the future be “classified as misdemeanors and not as crimes.”

The bill received a majority of votes in the Parliament Thursday night, Reduxx reports.

The offense was reportedly classified as a felony in a 2021 reform with a minimum one-year sentence for the offense. The maximum penalties introduced in 2021 will be retained, parliament states.

I figured this was about juveniles possession "child porn" (aka, nude images of their peers), but I didn't think of the other reason.

FWIW, we have done similar things by creating "sexting" laws to protect teens from child porn charges

Not trying to protect anyone, but it’s hard to argue to put juveniles with pics of their girlfriends in jail for this and similarly call them a sex offender for having sex with a girl their age when it’s against the law and label them for life.

I don’t know the right answer but this doesn’t seem all wrong.

Two 16 year olds can have sex...but the one 16 year old can't send a dick pic to the chick/dude he is banging without getting arrested for child porn.

Well carving out slices for them (like our "sexting" laws) seems prudent. Like we do with Romeo and Juliet laws.

I think this is the wrong approach because it inadvertently provides leniency to predators.

Especially considering that the age of consent in Germany is 14.

So then why not make it a misdemeanor for people under 18 or 21 and keep the stiffer penalties for those over 21?

It doesn't seem Germany structures their criminal laws like that. I imagine they have exponentially fewer criminal law than we do.
