Sorry, that dog doesn't hunt. If the above hypo was the nexus of the amendment, why reduce the minimum sentence to 3 mo? Why not just make a safe harbor for people who clearly arent trading the material for nefarious purposes?

Didn't they just have a politician post a video of himself eating shite and licking public toilet seats?

Spoke with my German friend who went to the German news to figure out what this is all about.

“I just took a deep dive into this. Yes, it’s true…but it’s *not a bad thing*.

A lot of the media outlets, especially the American ones, aren’t reporting the entire story.

So pre-2021 the sentencing for receiving / distributing child pornography was 1 to 5 years maximum. They then upped this in 2021 to 1 to 10 years maximum.

The 10 year maximum prison time remains effective. However, the crime is being reduced from felony (guaranteed prison time) to misdemeanour (potentially (and that’s the key point) prison time).

Under the law they passed in 2021 you were locked up for receiving / distributing child pornography. This means if your 16 year old son was receiving a picture from his 16 year old girlfriend on the mobile phone plan YOU (the parent) pay for, then you get locked up guaranteed.

So they’re changing it to help parents that suddenly have these charges because their kid received nudies from a girl in their class.”
