Are there others parts in code elsewhere that if actions are done for self defense, parental discipline through spanking, or a completely non-sexual way fight or other physical assaults involving kicks to groin, kicks to anus, or involve grappling that physically contact inner thighs stop person involved from automatically being charged with sexual battery (even with another crime like physical non-sexual kick to groin just getting charged with battery)?
Or what about actual team sport butt slaps? I don’t see if consent is implied or explicit, and i guess in past and for a long time implicit consent could be inferred in sports. Even if not seen as much today if wording in law was similar back in 2010 it seems like it was still seen a little more then by coaches, and a 2nd butt slap conviction gets labeled a sexual offense.
Just seems like sports or other non-sexual actions including criminal actions that contact groin, anus, or inner thigh would have come up some if not limited elsewhere in code. It shouldn’t be up to prosecutorial or judicial discretion especially if a 2nd gets labeled as a sexual offense as that seems likely to be abused. Unless second regular battery (or assault whatever Georgia uses) also gets labeled as a sexual offense or something similar.
