No. It means if found it becomes an additional factor in the severity of a sentence. Think like the difference between killing someone quickly and torturing them. Judge could add to sentence if he so finds. He won't but he could.

They made a lot of errors and had to bring in extra expert witnesses to counter-act Nelson's cross examinations to tell the jury "well that expert witness is wrong, I'm the REAL expert"


That wouldnt happen on a retry.

Idk if that was ever answered — idk if it can be honestly answered. It could be “estimated”. DC is only 140#. 1/3 of it maybe?

How late does the jury stay today before they decide to call it for the night? Is there a set time?

so the jury has started their deliberations?

if there's a verdict tomorrow... they may catch everyone unaware

I believe I saw Minny schools close Wednesday for the rest of the week in anticipation of a verdict

if they come back tomorrow... esp. with a not guilty on all counts... people who were expecting an extra day to prepare will be caught unaware

All states have maximum sentences for crimes. A Blakely ruling against DC would allow the judge to exceed that. Without it DC can only be sentenced to maximum under state law. It's been a while so don't hold me to that part 100 percent.

I’m sorry, but it’s clear some people have only been hearing the prosecution’s arguments and the only thing they’ve heard from the defense is that they’re racist because they brought up he had drugs in his system. This would be as if you only heard what happened in a baseball game when your team is up to bat and the only thing you’ve heard from the opposing team is that some player shanked a bunt and was out.

So your team scores 13 points and you think you’ve won, but in actuality the other team has scored 18 points and you lose. You don’t know about the other team’s points so you’re rightly pissed off when you lose. I’m done blaming the rioters because when cities burn it will be all the media’s fault for the massive amount of lies they’ve told.

asked this a few days ago, if this were not a high profile trial what would typical sentencing be for a conviction on any or all of these charges, and assuming DC is a first time offender with a good record?

He showed the same sort of frustration and visible disappointment when the city of minneapolis settled their case right as the trial was starting.

This time he definitely got angrier. He basically said she undermined an entire pillar of government of which she is supposed to be separated from and potentially violated her oath to the constitution.
