Race is also complicating the case because the natural witness to 'flip' (plead to a lesser charge and testify against the others) is the 28 year old driver but... he's the white guy. Unlikely they'd want the one white guy there getting the sweetheart deal with a potential 50% black jury.

Even if you tend to believe him, that is not enough for you to definitively say she was not dropped off on the side of Burbank, even going so far as to correct other posters as to your version of the facts.

Weak. I doubt the substance of the cases would be different in any major way at, say, 0.219 BAC. At 0.119 one could perhaps argue that the victim was sufficiently sober, but even that is far from a lead pipe cinch in court.
