That's what I don't agree with. The state-of-mind just wasn't there for the perpetrators, particularly for the first degree rape charge. Having sex with a drunk woman because she challenged your masculinity is just not that crime.
Manslaughter seems more reasonable to me, but I am not aware that there's any minimum mandatory penalty for manslaughter in Louisiana. And it's not a slam dunk anyway. There are too many similar situations, where a drunk person is expelled for being drunk and it's clearly not criminal, that a defense attorney would point at.

I don't know about that. Grand juries indict most of the time. Failing to indict is more telling.

So after they raped her they kicked her out of the vehicle for being drunk?
How is that comparable to a restaurant or sport event kicking out an unruly person?
He (Driver - Casen) kicked her out because he felt insulted, according to the video the defense lawyers just gave us. Get out get out of the vehicle.
"Seconds later" - according to her family attorney - she's run over.
You have some responsibility for people you let ride in your car not to dump them out on a dangerous roadway, right?
If someone is .319 drunk, they CANNOT CONSENT to sex. That's what the law says.
Not sure why that is so hard for folks to understand.

BATON ROUGE - An 18-year-old accused of raping LSU student Madison Brooks after a night of drinking in Tigerland is facing his third arrest in the span of a month over similar allegations.
According to arrest documents from the Baton Rouge Police Department, Kaivon Washington now faces an additional charge of first-degree rape after a sexual assault that happened October 2022.
Police noted the victim came forward Jan. 25, 2023, days after Washington's arrest in the Madison Brooks case.
The documents allege the assault happened after the victim got drunk at Reggie's bar in Tigerland and ended up at a male acquaintance's home along with Washington. She told police she was having sex with that person, identified as Karson Jones, while Washington was present. When Jones got more aggressive, she says she tried to get the him off her, but Jones reportedly pinned her down and refused to stop.
While that was happening, Washington allegedly came closer and started grabbing the victim's breast and genitalia.
The victim reportedly showed officers texts where Washington apologized for taking part, but Washington claimed he was pulled in by Jones. Investigators interviewed Washington this week, and they say he admitted that he walked over to the bed while the other two were having sex.
Jones was booked Friday for first-degree rape. Washington is still jailed in Livingston Parish on separate charges.

The audio and video don't quite match for me but I am hearing the following:
Madison: I'm sorry I offended you ...
Casen: Yes, guys take her out
Madison: Get out, get out.
Then AS SHE IS LOOKING AWAY they (lawyers? perps?) have audio edited into the video where Madison mentions "Ubering."
The audio quality doesn't match as she's looking away and it... just watch it over and over.
Whole thing was cooked for sure.

We'd have to see the full unedited video to know.
But adding in audio, selective editing, releasing it all to the public to interfere with the proper administration of justice?
Seems like a no-no by the lawyers - trying the case in the media.

the ONLY parts of the videos from the defendant's phones we will see before trial are edited clips favorable to the defense in the court of public opinion
