Generally I would say no, unless he had been convicted and took the stand in the Brooks case. But this may be close enough in fact pattern to fit under 404(b). All I can say now is that it will not clearly come in.

Picking up drunk girls and raping them or assisting likely a bit too generic to fit.

Interesting this came out day before the grand jury.


WAFB doesn't have it yet - the 3rd rape story.

Hmmm.

I seem to recall the third offense we were expecting was actually in Walker, Louisiana and also involved a minor.

So there still may be a 4th charge coming for Washington.


I think Casen has already cut a deal and will be testifying against the rest tomorrow.

Since we know the defendants aren't usually there, look for him and Mr. Long to be videoed walking out of the courthouse.

Yes, prosecutors can use the full video if they cracked the phones or got the full video off the iCloud or any backup sources.

Grand jury and eventual jury will see the full video.

This joker out of Georgia shows up to WBRZ and WAFB with comments like this:

Honestly, only one will likely end up getting convicted, the one with the other charges

the other two are likely gonna get off - not enough evidence beyond a reasonable doubt to be able to convict

no way the jury is gonna be able to come to any sort of conclusion with all the reasonable doubt that is gonna be put forth by the defense

Of course they don’t, you’re reading too much into this.

How can you tell the audio is edited if she’s looking away and you can’t see the movement of her mouth? She mentioned she would call an Uber and when she says “I” she touches her chest at that same moment.

The audio does not match the video. They could have added sound of Madison talking from any other time during the hour she was into the car to that point.



Why is the bottom 1/4 of the screen blurred out?

Go to 1:22.

That's weird.

Casen is hiding his face and wearing a hoodie to do so.
There was some plan to record this to justify booting her out of the car or showing her condition when let out??

I think this video idea backfires on them but will take hearing from the eventual jury post trial to find out.

It was lightly raining and cold out that night. They dropped Madison off and took off. A mile from Gardere. They don't wait to make sure the Uber shows up to get her?


To testify as to her state of mind - even with the video and BAC - I could see prosecutors flipping Casen. He'd testify as to the rapes taking place and, more importantly, to Madison slumping over. slurring speech, and the guys all knowing she was drunk and laughing about it on the way home.

Will find out tomorrow. If Casen is there, he's there to testify against the other three.

Long isn't in the video with the other three lawyers. That's a big hint what's coming...

What evidence is there that it was raining?

As for the driver, if he knew of Washington's past acts, then he turned a rabid dog loose. No idea where that plays legally but it's pretty telling of poor character.

Casen drove the vehicle to the area where the rapes took place.

That enough to 'aid and abet' the rapes?

Typically, to 'flip' a defendant he would be offered a lesser offense (say, reckless endangerment) in exchange for his testifying against the other three.

The jury is told he's been promised something and attack the witness because of that.

Casen would then testify they all knew Madison was drunk and testify the extent she was drunk. He'd verify the rapes took place. Basically, instead of pleading the 5th he would assist the prosecution - within the bounds of being truthful - and, in exchange, not face say life in prison for rape first degree or negligent homicide.

Since he has no record, Washington is obviously going down for the other rapes, he's 18 so facing the penalties of an adult, looking at prison? He will flip.

We will know tomorrow if he is there at the grand jury as he would be there to testify.

I believe that the prosecution would have to be aware that the defense would submit a spliced video, which would likely hurt the defense by having them withhold the entire video.

It makes more sense for the defense to try and find a way to defend the entirety of the video instead of cutting it up and hoping the prosecution doesn't realize, because they'll most certainly have the entire video.
