charges for them and anyone to whom they sent the video who watched it.

So if someone gets a text, sees it’s a video but truly has no clue what it contains and presses play they can get charged? What if they end it as soon as they realize what it is?

I don't know the specifics of that particular law, but in general, the "child" porn laws in LA, which include people over age of consent, but under 18, are very strict. Some would say draconian. Minimum mandatory sentences, sex offender registry for life, etc. But it's good for Jeff Landry and other politicians polling numbers, so don't expect any change.

And before the Moral Majority/Christian Coalition/Gun Owners for Jesus start raining abuse, if these assholes stayed home and beat their meat to their favorite porn website, Ms Brooks wouldn't have been raped by them and would probably still be alive.

Or maybe their favorite porn website is where they learned how they treat women

I can't argue that point.

But it could also be assumed that Grand Theft Auto and every other violent video game has a similar desensitizing effect on young minds.

But does he face (or rather his insurance) a civil liability of some % for not looking where he's going with a 1000 feet clear in front of him roadway?

You're losing me on the fixation with the Uber driver.

If driving with low beams (which shine about 200 ft in front of you), he would have had less than 3s @ 55 MPH. That's not a lot of time to discern 'is that something's in the road.' In a best case scenario she could've moved in front of reflectors or the white line which a driver can pick up on an object. Otherwise, it's really hard to pick out a silhouette against the whatever backdrop lies ahead.

Still no word on charges for the third LP case against Washington

What`s the word on the 3rd case in LP? Didn`t hear anything about it.

It's a 'felony murder' if the death happened as part of the felony (rape). Argument it did: they dropped her off here to avoid cameras and a well-lit place. They didn't call 911, bring her to hospital, even bring her to a gas station (would have cameras).

The rape would have to be part of the res gestae. Don’t see it, personally.

Supposedly, along with the 12 y.o. (at time of incident) who was allegedly raped in Livingston Parish, there was another victim as well.

That would be the 3rd arrest for rape by Washington if they come forward and if authorities feel there's reason enough to charge.

I believe it was mentioned in Kiran's story and then someone popped up here saying charges were about to happen. Nothing yet in the media.

But if victim is still minor not sure it'd make the media.

You there, Holden?

Agree.

Holden,
I'm checking out of this thread until there are further developments (the 3rd arrest or new news).

Keep fighting the good fight and see ya around!

Had real work to do.

Question. What shoes was she wearing? If she was in stiletto heels, the defense will argue she could not possibly have made the “jog” in a very drunken state.

Just a thought.

Even with a very large margin for error well below the .319 BAC as you can see beginning at .099 you have, Reduced judgment and self-control. Impaired reasoning and memory.

Can`t see any way the defense can claim she was able to legally consent. The only thing they can pray for is an ignorant and or bias jury.

BAC Level Generalized Dose Specific Effects
0.020-0.039% No loss of coordination, slight euphoria, and loss of shyness. Relaxation, but depressant effects are not apparent.
0.040-0.059% Feeling of well-being, relaxation, lower inhibitions, and sensation of warmth. Euphoria. Some minor impairment of judgment and memory, lowering of caution.
0.06-0.099% Slight impairment of balance, speech, vision, reaction time, and hearing. Euphoria. Reduced judgment and self-control. Impaired reasoning and memory.
0.100-0.129% Significant impairment of motor coordination and loss of good judgment. Speech may be slurred; balance, peripheral vision, reaction time, and hearing will be impaired.
0.130-0.159% Gross motor impairment and lack of physical control. Blurred vision and major loss of balance. Euphoria is reducing and beginning dysphoria (a state of feeling unwell)
0.160-0.199% Dysphoria predominates, nausea may appear. The drinker has the appearance of a sloppy drunk.
0.200-0.249% Needs assistance in walking; total mental confusion. Dysphoria with nausea and vomiting; possible blackout.
0.250-0.399% Alcohol poisoning. Loss of consciousness.
0.40% + Onset of coma, possible death due to respiratory arrest.

My point is that many juries would disregard the .319 given any basis to do so if their eyes see her running in heels.

Yes sir, and that`s a good point. The prosecutors and experts will need to explain in layman’s terms that a person can actually function with their limbs and motor skills somewhat but their mind isn`t functioning well enough to make a decision such as consent or anything else for that matter.

People push back so hard on this claim, and I've never understood why. It's always "muh studies," which they've never actually read. Nor do they know who paid for some clown with a PhD to make those supposed studies. We've just leaped to this "everything's OK" conclusion without good reason, and if you follow the money you'll probably find some gun grabber orchestrating it.

"It's not our ultra-violent media, it's those damned guns!"

You can most definitely run in heels while drunk. Don't ask me how I know...

Follow the money and you ll find a gun grabber orchestrating it??? The gun industry would be just as on board orchestrating it as they profit from violent video games as well. I know the NRA like to point the finger at violent video games but its ridiculous.

Frankly I dont believe either side is orchestrating anything regarding these studies but its the gun manufactures that license their firearms to appear in these games. They also get recognition and increased sales. Have you played any of these games? The most popular one Call of Duty has dozens of real world firearms each with dozens of attachments and a test range. That game has done more in the past 15 years to get kids(and adults) interested in particular guns than any other form of advertisement done by the manufactures themselves.
Sorry for derail.
