A jury is not "the average person." The jury is the group wisdom of 12 people. And they usually get it right.

Well I am tempted to ask . . . .
But the issue would be if you can run in heels while .319 drunk, so incapacitated that you basically do not know what you are doing.

Facts, also don't ask

She walked into fricking traffic. Your argument that she wasn’t incapacitated based on a 10 second video is moronic.
You are trying harder to say she wasn’t drunk than the suspects themselves.

That would be video voyeurism charges for them and anyone to whom they sent the video who watched it.
You've littered this enormous thread with so much nonsensical stupidity throughout it. Your knowledge of the law, common sense, and the general layout of Baton Rouge is no where near accurate enough for the amount of opinions you're trying to pass as facts.
No ones getting charged with video voyeurism simply b/c they watched an unknown video that was texted to them. You can get charged if you share it after watching it, but no one is charging anyone for watching a video that they received via text.

It would not make sense to disregard the BAC level but I dont think its out of the question to consider other evidence to determine if a rape took place or not. If your average person is having difficulty remaining conscious at .319 (and hers may have been lower or higher at the time of alleged rape)then why would a jury not consider what is seen in the video? Unlike DWI, there is no legal line defining what is too drunk to consent. So all they have to look at is fact patterns including what is seen in this and other videos to determine her physical and mental state.

Agree.
As Judge noted, there are multiple layers to this legally. But there is one and only one timeline and that has its terminus (sadly and tragically) at 3AM on Burbank in freezing cold weather.
Every story of what transpired is forced to go there.
IOW, one has to find her then blind, mentally ill, running from something/someone, or with a BAC of at least .319 or a combination thereof.

I’m trying to be clear-eyed and incisively analytical. (It’s hard to do the latter when you stand back and see the tragedy, though, and the sadness.)
And unless you are the Uber driver or are LE, I doubt you can know whether she “walked into traffic.”
Her getting hit moments after they left her is strong evidence. It is not conclusive.

The uber driver stated she was standing in the road, that`s all we know from what should be a credible witness. For all we know, she could have been dropped off right there where she was hit and didn`t walk anywhere. The only other witnesses are the 4 idiots.

You've never heard Judge Ellison address a jury.
You can read it here, but basically he describes the jury system as the bedrock for freedom, for which many American men and women have lost their lives.
Then he tells them that their service is just as important.
Then he reads of the list of those who died this past week defending that freedom.
No one wants off his juries.

Just asking (and doubt anyone posting knows the answer), but:
- Was the Uber outfitted with cameras?
- Did any of the homes in the development have security cameras? They might confirm some things.

I have not seen anything indicating one way or the other.

It did not look like it, but it is hard to tell. If the memorial is the place of the accident, I doubt any cameras would have recorded it. There is a fence on that side between the road and the houses, and the cameras from the Pelican Lakes side would not have covered that area.
Hope I am wrong, but I don't think so.

I was thinking these might shed light on the three addresses and where she left the vehicle. Might show her walking to get to Burbank (or confirm her absence).

1. People who have an agenda or 2. are too stupid to get out of being on a jury comprise many juries. Also the trial judge carries great power/influence in determining what evidence the jury gets to consider usually on an “abuse of discretion” appellate standard. Even though it has these flaws it’s still the best system to determine these things but it has it exploitable weaknesses.

It`s likely LE has tried to get footage from all over that area because the idiots may have lied about the when and where they went. So far only the outside of Reggie`s footage has been release to the public as far as I know.

No you aren’t because you never talk about all the evidence that supports that she did have a BAC of .32
For example, video of her falling 3 times inside the bar and on her way out the bar and video of her drinking random drinks off of other tables.
All you ever talk about is the video of her crossing the street.

He's trying to poke holes in theories while pretending to stay objective. Its the internet version of cognitive dissonance.
Lawyers will be valuable in this thread when the trial comes around, they're just obfuscating the shite out of it right now.
