The driver would have to be a real piece of shite to go the emotional damage route , but there are plenty of people who would try.
The damages to the vehicle would be a legit claim that he really shouldn’t have to come out of pocket for. It would be a huge moral dilemma to be be the driver though. His vehicle is how the person makes money, but do you really want to bring it up after the family lost their daughter.

You have an obligation to look forward while driving as someone may be turning. Vehicle may be stopped. And, yes, someone may be in the roadway. 20-30% at fault with a $1m case is still a lot of money, but I won't debate the point further.
Distance from the location of death memorial to Gardere is .6 miles. She was .5 miles from the sheriff substation and help.
Distance from location of death to likely location of rape is 3.6 miles. If they dropped her off inside the neighborhood it'd depend on how far into the neighborhood it was.
If she had her phone an had she been able to dial 911 (or they did on her behalf), help was a minute or two away from the sheriff.

Poster just sounds like some newspaper reporter. Throughout the thread they just seem to be piecing together rumors on here and compiling them for their story.

without police issuing anything I don't see anything happening to the uber driver
similar to the lady that was hit further down burbank by two vehicles - they were not charged either and are not facing any lawsuits

Those were both 'hit and run' and crimes.
For Madison the Uber guy (?) did stop, render aid, call 911. He wasn't charged criminally.
But does he face (or rather his insurance) a civil liability of some % for not looking where he's going with a 1000 feet clear in front of him roadway?
I say, yes.
But other 'jurors' here say no.
I'll check back in later with the 'night crew' (Judge Holden) on it.
We've had a non-gaslighting non-personal attack bashing conversation here but I understand people don't agree and debate with the intellectual skills and capacity begifted them by their Creator.
Whatever the source, I hope any funds go to the foundation as it is a worthy cause.
