And the driver could claim trauma for having been put in a situation where he innocently killed someone.

The driver would have to be a real piece of shite to go the emotional damage route , but there are plenty of people who would try.

The damages to the vehicle would be a legit claim that he really shouldn’t have to come out of pocket for. It would be a huge moral dilemma to be be the driver though. His vehicle is how the person makes money, but do you really want to bring it up after the family lost their daughter.

You have an obligation to look forward while driving as someone may be turning. Vehicle may be stopped. And, yes, someone may be in the roadway. 20-30% at fault with a $1m case is still a lot of money, but I won't debate the point further.

Distance from the location of death memorial to Gardere is .6 miles. She was .5 miles from the sheriff substation and help.

Distance from location of death to likely location of rape is 3.6 miles. If they dropped her off inside the neighborhood it'd depend on how far into the neighborhood it was.

If she had her phone an had she been able to dial 911 (or they did on her behalf), help was a minute or two away from the sheriff.

It's a comparative fault state.

You are driving you have to LOOK AHEAD AND STAY ATTENTIVE WHILE DOING SO.

Right?

If someone is in the road, hit the brakes. I've dodged a deer twice at night. You've never done that?

Was Madison at fault as well? Yes. 70%? 80%? Possibly that high. 100? No.

But we can agree to disagree.... as would jurors.

Poster just sounds like some newspaper reporter. Throughout the thread they just seem to be piecing together rumors on here and compiling them for their story.

Oh let me join the site and I need a name. Google famous lsu football players. Ill use that name, add tiger and some numbers and Ill just blend right in!

without police issuing anything I don't see anything happening to the uber driver

similar to the lady that was hit further down burbank by two vehicles - they were not charged either and are not facing any lawsuits

This case has CONSUMED you. I have no idea how many posts you have in this thread, but it's a tremendous amount. Alot of the information you post, you just keep parroting over and over again. You'd do well to take a "sabattical" of sorts from this thread and give yourself a break from it.

Noticed this is well. Its like he bumps the thread with re-caps hoping someone will drop new tidbits of info for his reporting elsewhere. Odd.

Yeah. And an old woman.

And short of a child, I'm never dodging shite again.

Flipped between 3 and 10x last time. I'd love to tell you how many, but I lost count after the third complete loop.

Lets all give a little grace here. This case absolutely torments me as well. I think I check in here frequently because I have a lot of anxiety about having a kid at LSU right now and it gives me somewhere to park it.

Fine. no levity allowed.

I would think strict liability would apply - serving underage is different than overserving adults

The hit and run drivers that killed the old lady?

Or this one:

BATON ROUGE, La. (WAFB) - The man who was run over and killed by a hit-and-run driver in Baton Rouge this weekend would light up any room he walked into, his grieving girlfriend says.

Jude Jarreau, 44, an avid LSU fan and father of two, was attempting to cross Ben Hur Road near Burbank late Saturday night when he was hit by a vehicle.

Baton Rouge police are now looking for the driver of that vehicle, believed to be a black Range Rover SUV, who fled the scene.

LINK

Those were both 'hit and run' and crimes.

For Madison the Uber guy (?) did stop, render aid, call 911. He wasn't charged criminally.

But does he face (or rather his insurance) a civil liability of some % for not looking where he's going with a 1000 feet clear in front of him roadway?

I say, yes.

But other 'jurors' here say no.

I'll check back in later with the 'night crew' (Judge Holden) on it.

We've had a non-gaslighting non-personal attack bashing conversation here but I understand people don't agree and debate with the intellectual skills and capacity begifted them by their Creator.

Whatever the source, I hope any funds go to the foundation as it is a worthy cause.

Still no word on charges for the third LP case against Washington.

I'm not sure if that would hit the news given the age of victim. Only reason the 2nd case hit the news was media coverage.
