Carver went in out of guilt.
Washington went in out of arrogance.
That’s my take.

It's also scared the hell out of me as a mother, even though our youngest is almost 22.
Im a father of a wonderful 16 yr old girl. Its not lost on me that its probably due to her that Ive commented more on this thread than I have any other since I joined TD.
We have had some heartfelt conversations regarding this case.
If Madison's family only knew how this has opened lines of communication for families with teenagers, they'd know her death will not be in vain.

Did they initiate contact with the police, or did the police ask to question them? I assumed they tracked down the license plate, but maybe they went forth on their own.

Depending on how the case (or other cases) shakes out, she may have also helped bring a budding serial rapist to justice.

You are absolutely right. We have also had lengthy discussions with our teens about this situation. Our son obviously had a slightly different conversation than our daughter.
I appreciate that the family attorney mentioned them wanting to make sure her death sparks changes on campus and how students keep themselves and others safe.

Her being dead likely made this a case to begin with. That’s not a new opinion or a radical one. Her death set the investigation in motion. But we can’t say for certain that she wouldn’t have gone to the police either.
Your alleged victim dying, possible due to your actions, is also a stupid defense.
I wouldn't pursue that angle as an attorney.
And if she did press charges, the police would've identified them just as easily as they did in this situation.
It would've been harder to prove. Likely depends on the physical evidence and rape kit.
If what supposedly happened is accurate, I bet she had some traumatic sexual injuries that should come out at some point.

Not to mention there's a good reason alot of people don't have completely spontaneous anal sex. Sometimes you end up with quite a "mess", for the lack of a better term, if the female is not fully prepared for it.
I've been saying this from the beginning, but apparently some of our resident incels watch a lot of porn and called me naive.
The anal sex aspect alone, assuming that did happen, is a crucial piece in my opinion. Sure people do it. More power to them. But it's not something that is generally done in that circumstance: spontaneous, no lube, probably no protection, in the back of a car, on film.
Would potentially be extremely messy, painful and traumatic.

I'm talking about events that occurred prior to them talking.
They obviously knew they were taking advantage of a very drunk person in their own words.
Sheer stupidity.

quote:Her dying is not the defense. The defense is that she consented. That she can’t dispute that is beneficial to the defense. It’s the irony of her death. It started the investigation but it’s the biggest hinderance to getting her justice. That being said, someone made a good point in the last few pages. Perhaps this ends in the lifelong torture of a serial rapist. Would be a bittersweet ending that her death saved any girls from being molested by Washington in the future.

I can be charged for drunk driving and killing someone….despite not having, according to you and the law, “all my faculties”.
Yet, a girl has sex, while being drunk, and it’s rape.
Can’t have it both ways.
Yes you can. Driving a vehicle is not a right. If you are planning on drinking, then you have a responsibility to make prior transportation arrangements.

Are people really debating the "previous" wording?
It's previous to her death, not a previous night or incident. That's just a doctor speaking in purely cold medical lingo.

THIS^^^
Her family has set up a foundation in her honor of her with this exact mission; to educate and communicate these dangers.
Hopefully her life and legacy through this foundation will be a beacon of light in a very dark world.

No, not solely. But it appears that will be part of the greater argument.
"She did consent, and the only reason we are here today is because she's dead."
I think that will backfire.

There's an ambiguity to it for us non-medical types. Some were questioning if it referred to some event prior to 1/15/23.
I took it to mean prior to being struck by the vehicle.

I went through this last week. Can’t recall the last time I actually had vivid, bad dreams about something, but I had them that night. This whole thing gets me sick. I hurt for her family. Even if the boys are found guilty, nothing good will come out of this for the Brooks family. They’ve lost the only thing that matters.

BS. My heart breaks for her family but I also don’t think lives should be ruined for the guys when there is equal blame that night.
Some of you would’ve fit right in in Salem, Massachusetts.
