Massachusetts revised code statute regarding not guilty by reason of insanity shifts the burden to the State to prove that she wasn't insane at the time of the murders rather than an affirmative defense that the defendant has the burden.

Most of the jury is going by the letter of the law, which is arse backwards in Mass. and creates an impossible standard: prove the state of someone else's mind.

I feel like her planning before the murders + attempt to extend her husband's absence during the murders showed that she was sane enough.
I'm pretty ignorant on the issue, and I promise that I'm asking this in earnest and not trying to rile people up, but... what are the odds that Clancy isn't prosecuted again? If it were 11-1 in favor of convicting her, then 100% the prosecution tries again. But only 1/12 voting guilty this turn, the DA probably knows that a conviction in round 2 is a long shot. It's Massachusetts, so the DA is most likely pretty left leaning. Also, people say that the prosecution was pretty inept. Everyone knew that this was going to be a high profile case, so if the prosecutor was tarded, maybe the DA did that intentionally.

Someone that runs thru their 2nd floor glass window in an attempt to kill themselves and ends up paralyzed is clearly insane.

Ordinarily you might have a point.. but literally because of this thread, and thousands like it on other boards, and the PR that has been generated in public- the chances she wont be retried are nada, nil, zero .

Nothing about this case is easy.. but I do think it's hilarious how so many armchair experts here and on other boards act like they were in the court for every minute of testimony, and in the jury room for every second of deliberations.. I dont have an opinion either way because I WASNT THERE .
