re: Bricks and Minifigs (Lego reseller), scammed a family out of $200k in legos

If BAM was smart, they would ask for mediation and put this all behind them. Ask Ben to issue an apology for how he acted and give the family back everything they have of his.
The more they double down, the more negative press they get and it looks like it’s killing their franchises.

They are trying to force the former franchise owners (Chrystal and her husband) into mediation.
Ben, Brian, and everyone else are being sued in Utah state court and they are trying for civil RICO to get triple damages.

He didn't offer good value on any of the sets I wanted to sell. I sold them nothing. Worse attitude than a shady pawn shop.
I mean they don’t stay in business by buying for full market value. If you want that, sell on eBay.

Exactly, but apparently their corp language states that they offer a certain percentage window and stores aren’t adhering to that.
But that has nothing to do with this situation. This is on the Corp office, how they acted in taking over this particular franchise, and apparently letting a Corp employee take it over.

Trouble is they aren't smart and they continue to show that at every step. Who knows, maybe they really aren't liable for the consignment agreement but they are still on the hook for the sets which they should have returned day 1.
it seems obvious they saw a failing store, which just so happened to have a valuable product in it, and sent two of their buddies to go take it over.
Ben's legal trouble aside, if BAM doesn't start acting like an adult they won't have a company when all is said and done. That ending doesn't really matter to me b/c they come off as nerds and whatever but it is the cops who need to pay for their actions. and pay big IMO.

If I'm not mistaken, that isn't the only store that those two own. I'm wondering if other franchises have been "taken over" like this by other corporate employees?

They took over at least one other franchisee in Florida and fricked him by not switching the lease over and not paying it, sticking him with the bill until the landlord had mercy on him when the location shut down.

Franchise agreements are so skewed in favor of the franchisor, that they can basically do whatever they want to their franchisees. I just went through this and no matter how right you are, they can always find a way to screw you if they want to. They have all the power and it's pretty sickening.
A lot of franchised companies are also dealing with corporate getting bought out by private equity. Then everything becomes about growing as fast as they can and their turnover becomes atrocious. You become a very small cog in a very large wheel.

Who said anything about full market value? I said good value. For somewhere between wholesale and retail, I would have gotten rid of some Lego sets. Everything he quoted me was the lowest of rock bottom. I didn't go there to give my stuff away for free.

They have taken down the GoFundMe.

Well good on you for recognizing your collections “value”.

Yeah, the GoFundMe is totally gone and Ben just said “I can’t talk about it or I go to jail”. I believe it was ordered by some Mormon judge in Utah, I’ve seen his name thrown around but I don’t recall it right now. There’s gonna be plenty of videos about it soon enough though. Pretty wild.

For the legal gurus, serving papers via email is legal? I mean, he's admitted that he has them, so neither here nor there now, but I always thought you had to be served in person?
His entire plan was to try and get BAM to sue, is he playing 4d chess?

All of the attorneys covering this on YT say the gag order, without hearing Ben's side, will get tossed once they all go to the first hearing.

BAM is praying this goes away before Ben gets his hearing at the end of the month to overturn the TRO.
I don’t see this going away. They keep pissing people off.

The GFM is back up, likely due to public pressure
LINK
So far Youtube has ignored the TRO, Patreon CEO told BAM to go F themselves, and now GFM put the fundraiser back up
3 strikes for BAM.
ETA: Good video on the TRO

They can successfully argue Ben needs to remove his own videos on the subject.
I would but keep copies of them for when the TRO is lifted.
This won’t help BAM, IMHO, because portions of Ben’s videos, plus things like the unredacted body cams are already floating out there and will continue to draw attention.

Suing Ben and the owner's son are horrible PR moves. BAM is run by idiots who need to learn about the Streisand effect

Not discussed here yet but Coffeezilla did an investigation of the whole mess.
The actual video is on Patreon for now but the cliffs have leaked. At least part of what leaked is that Brandon Best drove a U-Haul to the Salem-Kazer store the night of the takeover, which the company denied. That combined with some other factors implied that Brandon removed inventory from the store that night and brought it to the Eugene store.
