Yeah. On one hand, my pure guess is that he would have stopped before the kid drowned if nobody else was there. But I can't say for sure. And I'm not sure he can avoid the charge on a contingency like that given the video doesn't look like he had plans to stop.
I've never really seen an attempted murder via drowning charge play out. I'm not sure how they account for force/time/etc. Probably similar to choking scenarios (also unaware of how those usually play out).

According to the article, the kid was dealing with multiple injuries from an accident a few months prior. You can see his crutches laying on the ground next to him when the fight starts.

i my defense i *DO* own the lake in front of my house
i've got the paperwork and had to pull it out when some a-hole teens posted up and started claming 'imminent domain' or some shite and we had to get the cops out and showed them the paperwork and these a-hole STILL wouldn't leave and the cops almost had to cuff them to get them to go.

eta i have a few photos & video from the whole scene my wife took i can add to the thread
