Am I owed this paycheck? UPDATE PG4: OH LAWD, ITS STILL COMING

My last day of work at a salaried job where I was paid twice a month was July 8th. I received a full paycheck on the 15th, which I thought would be my last. I unexpectedly received a full check this morning. Am I entitled to this check since I worked part of the month? Or do I need to go ahead and contact my previous employer?

I talked to HR during my last week and specifically asked them about this and they told me no, they don't pay out vacation. I had two weeks left on the books. Maybe they took pity on my and paid it out anyway.

I would let them know. They will claw it back if they figure it out. Unless they paid you vacation time owed on that pay check run.

I would ask the former employer about it. There is no such thing as magic money. If they find out later a mistake was made, they’ll be in your arse to get that money back.

Different states have different laws, but I recall an attorney telling us we had to adjust our policy manual if we wanted to take a similar approach. Basically, if the manual does not say this, they have to pay it out.

Edit: I should specify, our situation involved sick time with the way it was accrued (similar to PTO) actually contradicted they way we applied (use it or lose it during the year). So, we had to lump it all together as PTO and specify the portion considered sick and our policy at separation.

Depends on when they pay you for your time. That check in 7/15 could have been for the 2nd half of June, and this check is for the 1st half of July

I'm leaning toward your latter explanation. I think I'll just wait and see what happens on the 15th of August before I contact anyone.

I should point out that I worked at a satellite office. It wouldn't surprise me if my boss didn't tell corporate I officially quit until a good deal later. I might just go straight to him before asking corporate.

Are you in LA? They are required to payout vacation time.

Happened to me once. I contacted them, and never heard back. Kept the money and they never tried getting it back.

I assumed I would get it paid out. It wasn't until my last Monday that corporate told me they don't do that. As to why I didn't walk out then....good question.

In two jobs I left in Alabama, they paid the % of vacation accrued minus whatever I had used.

Example:
Employee gets 4 weeks vacation per year.
Employee uses 1 week of vacation in March.
Employee quits half way through year, thus earned half of 4 weeks or 2 weeks vacation.
Employee is entitled to pay of 2 weeks minus the 1 week used, thus paid 1 week of vacation pay.

When you say you had two weeks left did you have that much already accrued and unused or that much left in your normal annual allotted time? There’s a good chance those two things aren’t the same thing.

I would stop accessing your past work services. Saw it cause problems for a past coworker. Company knew they left fwiw, which apparently yours does not.

They are legally responsible to pay out your unused vacation time. It’s a “benefit” that you’re entitled to

Just keep it.
If they come back later, you can even up.
But odds are overwhelmingly that you’ll never hear from them again.
