No one is going to buy that. It would come down to when was it more likely to happen. People will say it’s more likely when you’re drunk as frick and struggling in a car. And it’s not like having rough sex the day before means trauma wasn’t also caused that night. I know these oil slicks have to put together a case but jurors aren’t going to get distracted by that.

I think you're underestimating the impact of a doctor sitting up there and testifying that the physical trauma cannot be conclusively tied to the events in the back of the car.
I don't think the case will hinge on that, but its certainly something the defense can and will do--if the judge lets it in over the rape shield.
As others have said, whatever videos from inside the car exist will probably determine how it goes at trial.

IMO it is theoretically impossible at this point to convict any of these fellows beyond a reasonable doubt.
I'm not sure if that's what the jury's standard is in this case, but if it is, the prosecutor will lose (especially if they need a unanimous verdict in Baton Rouge).

Agreed. He was a predator… he has been charged with raping a 14 year old….. before this ever happened.
