There's a gray area in that rule in regards to when exactly a player turns 38, its not as simple as you think.

The Warriors are at the luxury tax with Curry, Durant, Thompson, Green, and the rest of the roster filled out with minimum players.
Thompson will command a max deal when he can sign a new contract. I could see Green not taking a max deal even if he was offered one.

Apparently the rule outlines that the age stipulation is set by the season itself and is not factoring when the contract was signed. In other words, 4 years from exactly now Nene will will be 37. So if the time period starts from the time he signed the contract, it works. Instead, it says that he must not be 38 by the start of the season going into his last year . Nene turns 38 in between July 1st and October 1st.
