Andrew Bogut talks about the Josh Giddey situation

Not sure if this was such a good idea for him to talk about it but here's what he said:

- Thinks 19-21 yr old seeking out a 15 yr old is despicable.

- Thinks girl was "younger" but that she lied about her age and told Josh she was of age. It happened over a year ago.

- Says OKC and NBA have known about it for a year and have let Josh play.

- But then says per the CBA the NBA can do anything about it until charges are filed. (I'm not sure about that after Ja's suspension)

- Thinks Josh hasn't been contacted by police and it occured in California where age of consent is 18, which "throws a spanner in the works".

- Says from what he understands girl's family won't press charges.

- Says if he's wrong about this stuff he'll apologize. (lol)

Probably not the wisest to talk about it, but also if he doesn't talk about it, he'll just get destroyed for avoiding it. No win situation for him.

That tells me he probably met the girl at a club or something and had the impression she was older. As far as how old someone looks if you're at a college bar is it really that obvious someone is 18 vs 15 with a fake ID in some cases? Back then some of my friends looked like kids and some of them could go buy beer at the gas station without a second look.

On my GAF meter, this is registering very low. At worst case, it’s a misguided consensual relationship without any power dynamic (student/teacher, boss/employee).

A buddy of mine made a good point last week. If he met her in an establishment where you have to be 18 to get in, wouldn't it be reasonable that he thought she was of age? I know "she said she was 18" doesn't fly legally, but would something like that change things?

And if it happened in California, they'd likely arrest him for her being too old.

No idea about California, but in many states sleeping with a minor is one of the few criminal acts that don’t require intent. You can be in a 21+ establishment, she could have an ID that says 25 and she could even look 30, if she is in actuality under the age of consent then that’s a crime

Statutory rape is a strict liability offense so none of those extraneous factors matter.

Essentially, Is the person under the age of consent, did you engage in a sexual act with that person, if so you're guilty.

It would depend on the state’s laws. And maybe a judge would go on the lighter range of punishment if the defendant truly thought the victim was 18.

Most crimes require the prosecution to prove that the defendant intended to commit the crime. But in Tennessee for example, if you’re 28 and she is actually 17, that’s aggravated statutory rape, even if she had the ID and looked 30. And I don’t think there’s anything in the Tennessee code about any mitigation of any kind

That is my understanding as well. But Lord knows California may be different.

I do think age of consent is something that should be consistent country-wide though. If you can be in one state and frick a 16 year old and go to prison forever, or go half a mile down the road to another state where the age of consent is 16 and be fine, that’s a problem IMO. Make it 17/18/whatever, but it seems like something that should be uniform.

Thats incredibly scary. Like if you looked at her ID and everything, I mean do you need a notary to have sex?
