[embed]I wouldn’t be surprised to see another SEC lawsuit against LSU filed in state court in Birmingham, Alabama - a straightforward case that would not be removable to federal court. When a person or organization joins a private association, they agree to follow its rules in exchange for the benefits of membership. Courts treat the bylaws as a valid contract. If a member breaks a rule written in the bylaws, it is considered a "breach" of that contract. “ “A nonprofit association may assert a claim against a member or a person considered to be a member by the nonprofit association.” “Liability in Tort and Contract” AL Code § 10A-17-1.07(e)(2025).[/embed]
All these state AG’s, school presidents, chancellors, and AD’s all want to pin this on LSU/Lane.
Go ahead and do it. The non-profit part is kinda blowing me away now the more I think about it.

LSU should file suit in federal court to have Trinidad Chambliss declared ineligible. Because Ole Miss is a member of the NCAA, and:

I mean if the bylaws have been voided by a court order as non-constitutional that’s a pretty big fact that ole Tom is ignoring. If it was that easy to get around these court orders then why didn’t the SEC just pass its own rules regarding paying players and unlimited transfers?
For that matter why was the NCAA ruled against so many times? It’s a voluntary association of members with bylaws. Yet it lost all ability to enforce said bylaws after court orders.
Also Tom should worry about his boy Mike Lombardi who he was crowing about how there was no proof against him last month and he just resigned in disgrace. Focus on your own cases Tom.

Ugh. Once again, a private organization CANNOT tell a member to disregard a court order even if it conflicts with its bylaws.
The SEC is now going to have to argue why these players should not receive a TRO.

i agree with Tom....the SEC should file that lawsuit and in theory they are correct....but that means you have to have clear rules and that they must be enforced equitably.
so either when the NCAA says a person is ineligible....they are ineligible or they arent....no matter what a TRO says

Why is this so hard for these apparently “brilliant legal minds”?
We are pissed because the SEC isn’t enforcing its bylaws equally.
Trinidad is in violation of the bylaws
Texas OL is in violation of the bylaws
But the SEC only sued LSU and Lane Kiffin.

I'm curious as to how it would not be removable given neither LSU, nor its administration is domiciled in Alabama. I guess the argument would be the claims don't meet the $75k removal jurisdiction threshold...but I don't know if I buy that.
If anything, LSU would still remove the case to fed court and there would have to be a fight over a remand.
