Traditionally in criminal jurisprudence the superior size and strength of a man over a woman were aggravating factors in the crime of rape, regardless of whether or not a deadly weapon was involved

And HE was the first to report it. Not her. But she took that money though. And then wanted to report it and go through LSU. Yea she's trying to get more money. Because why accept what he gave you if you already knew it was a bribe? Could've used that to her advantage. The fact that he was forthcoming with the messages. If she still has access to hers, I wonder was it provided as evidence for the school hearing just in case he deleted something. There's a lot of questions for sure in this. Did he run to the police first to cover his arse because he knew she would go report it, so he tried to set the narrative? Or did she embellish what happened and is unstable as mentioned by others in the police reports?

The only thing I know for certain is, the more info that comes out the worse both of them look.

He knows what’s on the line for him. He should have taken every precaution and made sure it was ok before he proceeded.

If she intentionally baited him to make sure she had a case for monetary gain, this entire thing could have been avoided with prior consent.

It sucks that this is the world we live in, but it is and I’m sure they are both aware of that.

It's not a bad idea. Coitus, like buying a new car or getting termite service, IS a contract. The only way to end these stated claims of rape that may have occurred years earlier (thirty-five years earlier in the case of Christine Blasey Ford vs Kavanaugh)--- is to have documentation of express legal consent before engaging in said behavior.

This is getting serious. Most Americans are outraged at rape (look at the brouhaha at Cornell U. now). Just a carefully worded document, signed by both parties in the contract, preferably notarized, can bring to a close a troubled chapter in American civil and criminal jurisprudence.

Jesus. Not bashing you, but this is what feminism has brought us to. "regret" is now "rape". Absolutely fricking insane how feminine this culture has become.

Considering both parties consented at the beginning of the encounter, contracts wouldn't have made a difference.

The only way to prove what did or didn't happen is to record the entire encounter. Video is best, but audio only is the next best option. Good luck out there guys.

Never forget that he is presumed innocent until he has a trial and is convicted…Rape is a terrible crime and if he is found guilty he should spend significant time in prison.

Where's the proof? Unless there's signed documentation of consent then an allegation of rape has full legal credibility. And the burden of proof falls upon the defendant, not the plaintiff.

Done outside the legal process it very well could be.

She asked him to Venmo $1000 to keep her quiet

This whole thing is extortion after a consensual encounter

I'm trying to figure out if you're trolling or just this stupid. The burden of proof in a criminal investigation is on the prosecution.

You can't just accuse someone of a crime with no proof and get a conviction.

Ever heard of innocent until proven guilty?

Well, I had it explained to me by a Judge while sitting in the jury box. Now if she was beat to a pulp with his bare hands maybe so. Does not seem to be the case here.

the media piling on this case should be very careful
he's innocent until proven guilty
LSU did exactly what they are supposed to do under the law
Shanklin has rights to and you could say what he's going through now is punishment as LSU cannot play him until this is resolved

he will have his day in court

if LSU threw him to the curb he could come back and sue LSU along with the victim

I’m not talking about this case. I’m talking in general. I happen to know a young man, who had a date with a girl. They were NOT drunk…. AND she initiated the sex, and admitted as such. However, much like this, well after the fact, she brought allegations towards that young man….. baseless accusations, all because, as we would later find out, she was jealous that he chose to ask one of her sorority sisters to be his GF.

He was arrested, booked, the whole 9.

This young man was expelled from college, was not allowed to entertain med school, as was his dream. He had a good attorney who dug deep and found enough info on the girl to make her admit it was made up.

Nothing happened to her. He was damaged goods now, bc a woman lied due to jealousy.

That's the fundamental pillar of American criminal jurisprudence. In practice in cases involving sexual assault this pillar is thrown upside down-- the mere accusation of rape makes a man guilty in the court of public opinion. He becomes effectively an outcast in society and has to reconstruct his reputation. We saw this famously years ago in the Duke lacrosse case, which proved to be a lie made out of whole cloth.

She should have been arrested for filing a false police report and obstruction of justice.

Oh so you're a lawyer now tarzana the leftist? So a man's weight is an aggravating factor when determining aggravated rape?

Are you fricking for real?
