SCOTUS set to take up major 2A gun case in the fall

Big news. Heller decision ruled on persons right to have a gun in the home. This case could decide a persons right outside the home.

The U.S. Supreme Court said Monday it will consider how much protection the Second Amendment provides for carrying a gun outside the home.

The case will mark the first time in more than a decade that the court agreed to take up a central issue of the gun rights debate, something it has consistently ducked since issuing a landmark ruling in District of Columbia v. Heller in 2008 that the Second Amendment provides an individual right to keep a handgun at home for self defense.
quote:
The court agreed to hear a challenge to a New York state law that allows residents to carry a concealed handgun only if they can demonstrate a special need beyond a general desire for self protection. The law "makes it virtually impossible for the ordinary law-abiding citizen" to get the necessary license, said Paul Clement, a lawyer representing the challengers.
quote:
One of them, Robert Nash, said he was wanted to carry a gun in response to a string of robberies in his neighborhood. Another, Brendan Koch, also cited a desire to carry a gun for protection. Both men said they had completed gun safety courses, but both were turned down when they applied for permits. They joined a lawsuit challenging the law brought by the New York State Rifle and Pistol Association.

You would think this is a slam dunk for the 2A advocates but you can't count on anything these days

Clarence Thomas needs to have all his food cooked in front of him.

Holy shite why didn't we think of this before.
Ban guns outside of you home = no more mass shooting or gun violence!

Montana has already nullified whatever it is. Other states will follow.

I mean who is the State of NY to decide that you have to demonstrate a need "above and beyond" the general need to protect yourself?

Rule however they will, I'll still exercise my RKBA in and out of my home

I am cautiously optimistic on the 2A strengthening through this case. Well, not strengthening but being more widely interpreted. The Trump judges all are pretty pro-2A in their earlier rulings.
Hell, ACB thinks (and I agree) non-violent felons should not lose their gun rights.

Yeah, I am not banking on them to hold the line on much...

I share the same cautious stance. SCOTUS IMHO may strike the down the special need but be silent on what infringes on carry. In DC only 1 FFL holder is allowed, no semi auto pistols and only revolvers are allowed. You better believe if the dems get outraged, the filibuster will be in their crosshairs.
The real concern will be when an assault weapons ban get struck down. The dems will definitely use that ruling to garner support for packing the court.

"When seconds count, the police are only minutes away...."
The outcome of this case will be a litmus test for Biden's "Assault Weapons" ban.

Shall Not Be Infringed!!!

The most immediate impact a ruling for the challengers will have is force the few remaining "May Issue" states into "Shall Issue". Will be interesting to see how those states intend to evade such a ruling though, suspect it will take several more court challenges to set them right.

This is huge news and has the potential to make the 2nd amendment even stronger than it was after Heller.
Liberal gun grabbers are about to get screwed even harder than they were after Heller.
This is where the legacy of Donald Trump and Mitch McConnell will make its presence forcefully known.

Of note: Roberts, Thomas, and Alito were on the Court during Heller and all joined with Scalia in the majority in that case.

They'll drag out the process like NYC does. Sure the "proper cause" would be tossed out but the court appearances, tax returns, fees and numerous trips to the police station will be the norm in those locales.
Until the court renders the scrutiny level, we're only going to get bare minimum results.

Abandon all hope as long as John Roberts is on that court.

You don’t need a license because a right does no require permission!

Kav, Gorsuch, and ACB are gonna fold like a lawn chair
This idea that these people are "conservative" is fricking laughable.

Roberta can side with the Wise Latina and he’s still outnumbered. There’s no way it’s unconstitutional to make abortion contingent on a father’s consent but it’s constitutional to place conditions on the right to bear arms. This isn’t a regulation on the type of instrumentality (automatic/semiautomatic/bump stocks what’re), this is a condition on the right itself. Trump’s 3 + Thomas Alito - and the 2A Is preserved.
I predict ACB writes opinion as a hat tip to her mentor.
PS Roberta was a typo but I like it for Roberts so I’m keeping it. I’m glad they at least had the balls to hear this one.
