VOTE Yes on first 3 amendments---no on the rest

I have already voted. There are some pretty important amendments. Here is what LABI says about the first three and I agree.

This Amendment will help the oil and gas service sector in Louisiana remain competitive with neighboring states at a critical time for the industry, which has lost tens of thousands of jobs in the recent downturn. The Advocate editorial board recently endorsed Constitutional Amendment No. 1, noting “The major energy companies can’t do anything about the price of oil, but they might well, in a time of lowered profits, react unfavorably to new tax burdens. We urge voters to approve this amendment…”

LABI urges voters to support Constitutional Amendment No. 2, which makes a minor change to allow more schools and educational programs to access public dollars in the Education Excellence Fund. These investment earnings from the tobacco settlement are dedicated to public education, and the Amendment would add THRIVE Academy, the Louisiana Educational Television Authority, and lab schools operated by public colleges to the list of schools eligible for funding. The total estimated distribution to these schools is $190,228 of a total of roughly $15.6 million. The bill passed the Legislature unanimously, and LABI agrees that public funding should be available for an array of school models and choices.

LABI urges voters to support Constitutional Amendment No. 3, which seeks to allow more tax disputes to go before the Board of Tax Appeals and avoid costly, lengthy litigation. Currently, the Board of Tax Appeals exists as an optional trial court, and an estimated 99 percent of tax cases are filed with the Board because most litigants prefer judges with expertise in tax law to oversee the case. When there is a constitutional question today, however, the case must be transferred to district court and later sent back to the Board of Tax Appeals for trial on the underlying issues. This cumbersome transfer is administratively burdensome and can leave the matter in limbo for years, so this Amendment would permit the Board of Tax Appeals to hear the entire case before it including any constitutional considerations with the fallback plan to appeal the decision to state courts.


The last amendment on the ballot is about letting Orleans Parish exempt more property from property tax. That is the very LAST thing we should be doing anywhere in the tax. We need lower millages not fewer people paying property taxes. Exempting some from property tax just makes the remaining tax payers pay more as the debt these taxes service do not change just because fewer people are paying tax.

1. For. Taxation is theft, and this reduces it by keeping these few parishes from unconstitutionally extorting money mainly from oil and gas companies, which could end up deciding to move elsewhere anyway. We shouldn’t just wait for victims to fight and win in court if we can just pass a law to end the injustice immediately.

2. Against, the goal should be to get government completely out of education, not to spread money to more government schools, and certainly not to fund public TV.

3. Against. Let these tax disputes continue to be handled in courts with elected judges instead of some unelected, unaccountable board. The board would be just another unaccountable entity that could rule based on how well they are bribed or how much they support/oppose the plaintiff.

4. For. If New Orleans wants this authority to reduce taxes/theft even for just a few more people, it’s the right thing to do. It’s irrational to demand that everyone else continue getting robbed/extorted of their money just because we are. And if others in New Orleans think it’s unfair that their property taxes would increase to offset the exemption for poor people, then they should fight against their own property taxes instead of demanding poor people get robbed more. New Orleans could always find other ways to offset it, or just reduce their waste, or reduce expenses by shifting some of their control over certain services to the free market where it belongs in the first place.

I basically vote no on all amendments. Is there a state in the union that has more amendments to their constitution? The state needs a new constitution but does anybody trust any of the politicians enough to write a decent constitution? I believe the current constitution was written when EWE was governor, the second most crooked governor in state history.

These amendments are so ridiculous because there is no way even 10% of the voters possibly have any clue as to what any of this means.

I'm not slamming your post or your recommendation, just a general observation of the inanity of Louisiana.

1. Yes. An inventory tax is fricking moronic in the first place.

2. No. The lab schools are already better funded than most other schools and have had recent problems explaining multiple purchases.

3. Yes.

4. frick no. The current exemption is more than enough. Besides, the extra exemptions would just go to slumlords (primarily).

1, 2, and 4 have no business being in the constitution, and should get a NO vote.

3 should get a no vote as well, both because it shouldn't be in the constitution, and because it's a bad idea. LDR, these days, uses BTA as the appeal officer. That's never what it was designed to be. It's supposed to be more of an administrative law judge. Issues of constitutionality need to be in the district court system.

I will vote yes on Amendment 1 because if rig equipment for the continental shelf are stored here, workers will be paid to bring it in and ship it out. Jobs!

I am debating 2 because I don’t think “dedicating tobacco money to education” is proper government. I want my representatives debating education needs yearly, and raising or lower at need and as circumstances demand. I think amendment 2 makes a bad deal better, so I want to vote for it, but making it better might make it more acceptable, so I want to vote no. Leaning yes.

Debated 3. Efficiency sounds good but an unelected board in Louisiana just screams Political Corruption! Leaning no.

I thought New Orleans wanted to tax prior tax exempt property like churches, schools and hospitals. Even if wrong. Solid NO to N.O. because N.O. SUCKS. Stop stealing, sanctuaries, and put my statues back.
