I'm not taking the defendant's side or position but to answer your misunderstanding the First Amendment of the US Constitution provides a fundamental right to life. This fundamental right is extended to protection from the states via the Due Process Clause of the 14th Amendment of the US Constitution. This should answer your misunderstanding.

I'm not getting into a debate about capital punishment, but it does seem like if you're going to allow a religious "leader" from one faith to be there then you need to allow leaders from all faiths.
