I stand by my belief that preventative laws are amoral. Driving in accordance to traffic code while drunk shouldn't be illegal on its own, in theory.

This

If you can drive drunk within all ofher traffic laws and not cause damage then go for it. But know there will be a stiff penalty if you actually cause any havoc.

Sounds like their not reaching their revenue goals from DUI infractions.
Exactly.

How many people are killed by driving with a BAC between 0.05 and 0.08? I'm going to go out on a limb and say almost none ... certainly a statistically insignificant amount.

It's all about money and elections. Hell, a couple of years ago the national sheriffs' association came out against self-driving cars because they knew they'd loose a frick-ton of revenue - revenue that the taxpayers didn't vote for them.

FTR - I have never received a DWI.

Agreed. Make it an aggravating factor when dishing out punishments. And make those punishments extreme. That'll put an end to it quicker than any of our current laws.

other things can trigger a breathalyzer. Certain medicine, coffee, cigarettes, food stuck in your teeth can cause a false test.

Diabetics and people on intensive carb-restricted diets can produce a false reading on breathalyzers. They don't test for alcohol, they test for the body's metabolic byproduct of burning alcohol. There's a flurry of things that produce such byproducts.

I hope all of you go to jail because of this.

Yep. They think of themselves as conservatives too.

I wonder how receptive they’d be to more gun restrictions. After all, in this era of grocery stores and non-lethal defensive measures, do we really need so many guns?

Exactly what civil liberty is at issue here?

The right to drink heavily and then weave all over the road, apparently.

Just because you blow under the limit doesn't mean you aren't intoxicated. She might have been on other things too.

The BAC limit simply means it is presumed you are intoxicated. If you blow under that you can still be hauled off.

Good. Let's keep the drunks off the roads. If caught, should be 1 year in jail. Let's end drunk driving.

In the 1800s drunk driving was legal and there was no income tax and you could have children work at your factory and nice people from other countries help you pick your textile plants

How did America go so wrong?

Which will be too late for any victim.
