A driver that blows a .02% can be arrested for failing a field sobriety test today, the 0.08% threshold only sets the point where a crime has been committed no matter what.
Lowering the threshold to 0.05% lowers the point where a crime has automatically occurred, regardless of the circumstances. It was always a crime to blow a 0.06% and stumble through a field sobriety test.
So, this law reducing the threshold specifically targets those who would blow a .06% but still pass a sobriety test.

Most states it’s against the law. It’s like drinking and driving. People will always do it. I believe using your phone should be one of the heftier fines and punishments.

Like I said, it wasn't me. It was a colleague. He blew 0.00 on the PBT. Cop still says he was under the influence and arrested him. Cop said he was trained to detect when someone is high on weed. The dude has never smoked weed in his life.
He eventually cleared his name but he had to spend over $15k doing it...all because a police officer's opinion.

You can bet your arse that they performed studies on the increase in revenue that this law change would generate...which is the sole impetus behind the change. It has ZERO to do with public safety and everything to do with greed.

No, but have them get a ride home or have someone else come drive their car...once you pull them over and PBT/FST them and decide that they are impaired, then you are obligated to prevent them from driving.
