Uninsured Motorist Claims Process

My kid just got into an accident. Other driver has no insurance and it's his fault.

We carry UI Motorist insurance so we'll have to file the claim on our policy ($2k deductible).

For those with any experience with this, questions:
1. Was the insurance company successful in collecting from the at-fault party, therefore you receiving a refund of your deductible?
2. Did your premiums go up?
3. Any other thoughts/insights?

No way this happened in Louisiana. We don't have any drivers like that.

Let me help here.

You will pay.

Insurance company will profit.

Politicians will get free Sugar Bowl suite tickets from said insurance company.

Lawyers will make money too some how.

I was hit by a girl who was playing with her radio and failed to yield. She had just purchased insurance a few days before and if I recall, her coverage kicked in 14 days after purchasing. It was some local cheap insurance.

Had to go through my insurance and they were not successful collecting from her company. My premium did go up, but it was about a year later.. And it went up by like $60/month if I recall.

Now I despise people who drive with no insurance.

3. Use your health insurance to pay for the medical bills and don't make a claim for pain and suffering, and the hit won't be so bad.

My advice to you is your UM carrier does not have the same mindset that you do, namely; that they are there to protect you son against uninsured drivers.

Rather, they are of the mindset of settling your claim for the least amount of money possible and lowballing the hell out of you.

If the other party received a ticket, go to court and ask the DA to make restitution of your deductible a part of any plea agreement.

My kid got t-boned on the way to school a couple years ago. He was turning onto the street his school is on and a woman ran the red light without even touching the brakes. She was on drugs. No insurance, of course. His car was totalled.

1. Got a check for around $36k, but they recouped nothing from the woman. No refund of deductible.

2. Premium did not increase.

3. He got a herniated disc and has had back trouble ever since. I didn’t seek anything from my insurance company other than what was given for the car. I feel like they did their part in covering the car.

Premiums cannot be raised due to a UM claim.

Get a lawyer or you will be sorry.

Your UM deductible should be lower than your Comp/Coll deductible. So at least you got that going for you.

Yes. I had all the drivers information though and had a significantly lower deductible ($250)

I was legitimately shocked at how quickly they sent me payment for my deductible. I figured there was a minimal chance I would get anything. I received payment in the mail like a month after the accident IIRC.

Background info: I have Geico and it was a fairly insignificant fender bender

UMPD will be handled just like a non at fault collision claim. Shouldn’t be any different.

The process is you collect from YOUR insurance company and who really cares if they go after the other driver or not, that is THEIR problem.

Seriously, file a claim with your insurance, and they handle the rest. If it's ANYTHING other than that, you have some shitty insurance. I have Shelter and I've been hit twice by assholes who didn't have insurance, both times Shelter took care of everything , even paying for pain and suffering and such and in both cases I know they said they didn't go after the other driver, because how do you go after somoene who doesn't have anything to get? They just write it off as the cost of doing business and raise everyone's rates.

Had this happen with Geico. They paid my truck claim and my pain and suffering. Then they sued the guy to make payments for the deductible. Got like 4 different checks till he paid it off.

Edit... No rate increase. I think it's illegal on uninsured motorist claim. Not sure about that but my brother worked for Geico in AZ and helped me through my process.

Regular UM coverage is for injuries. Your collision coverage would apply here for vehicle damage. UM coverage comes into play if your kid or their passengers have injuries.

Don't hold your breath on your insurance company getting reimbursed by the at-fault driver or getting your collision deductible reimbursed. If he didn't have insurance, he's more than likely poor and the insurance company would be wasting their time/money on going after the guy or suing him to get reimbursed.

Your premiums should not go up for a not-at-fault accident. Premium may still go up due to an overall rate increase, but that would've happened regardless of this accident.

I waived UM. A few years ago, I was rear ended by a motorist who had an insurance card, but State Farm had trouble contacting the insurance company and felt the insurance card was fraudulent. The driver was an undocumented immigrant and the state trooper said its common for them to carry invalid insurance cards. Paid my $250 collision deductible, and since I was not at fault, State Farm told me my premium would not increase. About a year later, State Farm sent me a $250 reimbursement check. Apparently they got their money somehow. I need to read up on UM, but it seems like a scam.
