Tyler Watson, 20, of Gold Hill, OR, alleges age discrimination, citing an Oregon state nondiscrimination statute, after the two retailers refused to sell him guns.
The lawsuits, filed Monday, claimed Watson is suing to stop the stores from "unlawfully discriminating against 18- to 20-year-old customers at all Oregon locations." He also seeks unspecified damages and attorney's fees.
Field and Stream store is owned and operated by Dick's Sporting Goods, which announced Feb. 28 they were restricting the sale of guns to anyone younger than 21 years of age and ending the sale of assault-style firearms

He should win the lawsuit.
If those chains don't want to follow the law then they can stop selling the product to anyone.

We all knew this was coming.
The question is when this gets to SCOTUS, as it seems to be a no brainer that the Oregon courts and the Ninth Circus will rule against him.

Unless federal law changes the minimum age, he will win this lawsuit based on age discrimination.

I'm honestly interested to see what happens.
Age discrimination is illegal in the United States. Of course, that was designed to keep us from discriminating against old people..........but, this might be fun to watch.

Why? Unless he’s being barred from the military or going to vote, he doesn’t have a case being a 20 year old. They are not a protected class.
Anyone who thinks that someone should have the right to not bake a gay wedding cake should side with Walmart/Dick’s here.

Mea culpa, I spoke too soon.
Age is not a protected metric in federal public accommodation law. Oregon, though, does have a state law that includes age.
Hence the reason it was filed there.

Completely false.
Age is not a protect class in federal law. Do you think you can sue bars that don’t let 18-20 year olds in?

No he won’t. It’s over 40 that’s the issue. If I ran a gas station and didn’t want to sell cigarettes to anyone under 21, then that’s my business. They can go elsewhere and get the black lung.

As he should win. There is no worthwhile argument to back stance of these stores. At least with the cake, it was discrimination vs someone's right to not partake in something (think it was a 1st amendment sort of argument or something). This here is nothing vs discrimination.

Truth be told, this is correct.
Dick’s should be able to make a business decision and leave the results up to the free market to decide. Same as the Oregon bakers.
