No, because over 40 is a protected class. I can however say that I won’t hire anyone under 40. Tough shite.

Age should hold more in the merit of constitutional law than baking some persons a cake based on constitutional protections, infringing on their beliefs.

After looking more, Oregon does have some language on public accommodation and not discriminating based on age. I would be floored if a state court at any level in Oregon found with the plaintiff, however.

They’ll find a way for firearms to be outside the scope of the law

All of this cheering on a kid suing to force someone to sell him guns. This cheering from the same ones who were hysterical that two dykes sued a baker to sell them a cake.

Hypocrisy knows no bounds.

What is the hypocrisy?

The rights of the bakers were stepped on.

The rights of this young man are being stepped on.

please to help me understand.

A custom cake, that they needed delivered to their dyke wedding.

I'm not cheering him on. He can go somewhere else to buy his guns. Wal Mart and Dick's are, to me, perfectly within their rights to sell to whomever they want whenever they want, period. Just as the cake bakers should be...

If you don't understand something so blatantly hypocritical as this, I'm not gonna waste my time. Sorry.

I don’t understand why people are happy about this. The Oregon law is something most people on here would absolutely abhor if it applied to any other situation.

I was honestly surprised to discover the state had a law protecting age. Thankfully the federal government does not.

Umm no, right from a federal standpoint. I could be a total hypocritical 21 year old and tell a 39 year old that the only reason I’m not hiring him is because he’s too young. He would not have a case. I can not do that with a woman, a black person, or someone 40 or older.

Maybe Oregon has something different in their laws, but from a federal perspective, I am correct. Do you really think that Walmart and Dick’s would open themselves up to such a guaranteed lawsuit?

This is it. You’re right under federal law. But Oregon has an age discrimination statute, but it leaves exceptions for alcohol and pot. Look for the judge/lawyers to fit guns into Ann exception or being outside the intended scope of that law.

Age is not a protect class in federal law. Do you think you can sue bars that don’t let 18-20 year olds in?

Bars that make all their money off alcohol sales can't legally sell their product to anyone under 21 anyway. Dicks/Walmart can legally sell shotguns and rifles to 18-20 year olds, they just choose to discriminate against that age bracket. See the difference?

Yes. Please keep up with your willful ignorance and stupidity. Seriously, call your HR department now and ask them if it’s legal or not to discriminate against anyone under 40. They’ll tell you the same thing I’m saying.

No, I do not.

Oregon state law, perhaps.

I find all the people bringing up the protected class arguments to be humorous primarily because they seem totally OK with the fact out government is OPENLY practicing discrimination by making it illegal to discriminate ONLY against certain people.

I mean, why exactly is it illegal to discriminate against you if you're female, but not if you're ugly?

Maybe bikini shops should ban selling bikinis to women over a 25 BMI.

And make no mistake, there ARE other groups vying for this government protection racket. The obese are angling for protection from discrimination. Etc etc.

I personally think a business should be able to sell to whom they wish and, generally, our government agrees..........unless you're part of the protection racket.

And THAT is bull shite.
