I am assuming UIM is the same in LA as in AL, but you and your passengers, if any, are leaving some aspects UIM coverage handles on the table. What if your passenger(s) don't have health insurance and get injured? What if you and/or your passengers needed monies for pain and suffering or lost wages to litigate this in court...you are leaving that on the table without UIM coverage. Also, your liability will not cover your passengers generally if they are hurt in an accident, that falls under UIM coverage....again assuming UIM coverage works in LA as it does in AL which I believe it does.

It's better that it happened to you, another lawyer, than to some schlub that would have to pay another leach, err, lawyer to fend off this slime.

Blame them not the uninsured motorist

Interesting since only one of these is actually breaking the law.

Are you really suprised someone in the bottom third of his high school class cannot adequately preform his job? Just be glad you were not shot.

If you are a personal injury attorney, this is the best case of “what goes around comes around” I’ve ever seen

A buy up is only 66 2/3rds on a LTD.

LTD is usually not taxable if you pay for it after taxes. So, when you take Uncle Sam's hand out of your pocket, that 66 2/3rds is pretty good.

You don;t understand how this works do you? YOUR liability coverage only applies if YOU were at fault. Lucky for you no one was hurt or they'd have been shite out of luck.

Obviously water under the bridge now but how much would've a dashcam helped? Both in the ability of a front-facing camera too see the accident and how much help the footage in the courtroom would've been.

I ask the latter because my younger brother had an accident where he was nervous and admitted when it very likely the other driver's fault. My brother's insurance basically said if you admit fault then it's unlikely even camera footage from a nearby building could help reverse the original statement.

Im pretty sure I would have raged hell if someone hit me, it was clearly their fault, and the cops said I was equally at fault.

Well you don't know what the cop is going to do until the police report comes out, which is usually a week later.

That’s why I think some frickery is afoot. I have clients tell me all the time that their agents steer them away. “You don’t need it if you have health insurance.”
This is late, but I think the companies push the agents to discourage UM. It is mandated by the State to be offered and provided if you pay for it, but there are too many problems and penalties for mishandling it and not making tenders. Plus all the uninsured drivers and minimally insured drivers means there are lots more claims here.

If you have full collision insurance, health insurance, and a job where you wouldn't have lost wages from hospitalization, then what is the advantage to UM?

Collision only covers damages to the vehicle - not you physically.

Do you want to be responsible for paying your health insurance deductible and co-pay's when someone hurts you? That's what UM covers.

What if you're in the hospital for 6 months and cannot do your job at all? Or suffer a traumatic brain injury and can no longer work?

It's these types of things that UM is for. It's relatively cheap to have added to your policy. Worth it in my opinion.

has now lawyered up.

The cops wrote a bullshite report and didn’t assign fault. They didn’t bother talking to the eyewitness. Now I’m about to be sued.

Yeah, I do this for a living and nothing should surprise me. But I’m really hating humanity right now, because I am the one being victimized. fricking liars on all sides. My profession is a cesspool.

eh, I heard you once lost a case against a pro se plaintiff. So I'm sure losing to an uninsured motorist will be pretty much on par with that.
