Is this guy going to jail? UPDATE - Murder charge for cop and husband

That is Deputy Shauna Thompson and her husband Terry. These local heroes put their lives on the line to prevent a heinous public urination episode at a neighborhood Dennys, and it just so happened that Mr. Hernandez asphyxiated and eventually died as a result.

Of course, no arrests were made when Deputy Thompson's co-workers arrived. And the included video has all the greatest hits we've grown accustomed to seeing. The dying man being ignored and unaided as he kicks and gurgles. The local hero laying prone on the perpetrator with solid placement of the choke hold. His heroic deputy wife assisting with the immobilization. The ignorant bystander claiming recording the incident is illegal and the videographer will end up in jail. All the usual hits we're used to by now.

So will the spouse of the LEO receive the same "benefit of the doubt" that the deputy would if she were the primary in the fight?

Is anyone going to jail?

ETA: Upon further review, Mr. Hernandez looks to have bloody knuckles.

This is bad. Who in the hell do the bystanders think they are telling the cameraman he is going to jail? I see where one is the daughter. That could get those people charged with intimidation, no?

It's pretty funny what lengths some LEO go to prevent stupid crimes. I bet they feel great about themselves.

Why is her non LEO husband taking lead in restraining him? Does he have any right to do this? Being a misdemeanor I'm not sure citizens are allowed to intervene?

I saw this earlier.

Even if they did fight, that is no reason to apply a choke hold like that for that long. Get a knee in his back, cuff him, take his id and let him go for an on duty cop to pick up a block down the road.

To me, it seems, the husband followed him outside and escalated the situation, when a quick call to actual police would have been the thing to do. I'm sure his old lady had personal cell phone numbers of her co-workers.
I think the guy wanted to flex his muscle and show he can do all the cool cop restraint moves too which ended up killing the guy. That's murder, Chief.
