He's right though, seems unnecessary to do that. But Sheffy gets such a hard on for being first, he likely didn't think it through

For the person who took the picture - Members of the media have some protection because of the first amendment.

However, whoever was working for the hospital and either took the picture or made the chart available for someone else to take a picture is in serious trouble. There's no way there aren't firings at the hospital where that chart originated. PP and the other parties whose information was released to the public have an easy lawsuit if they want to go that route.

When I made that initial comment I was referring to whatever probably low level tech took that picture and released it. I wasn't even thinking media.

With that said, whether it is a HIPAA violation for ESPN to tweet it or not it still seems really unethical.

Can't say I'm surprised though, journalists will do anything to be first on a story.

I know your trying to be a know it all smart arse, but it doesn't take an expert to know that someone taking a picture of medical records and releasing them to the ,edit is a clear HIPAA violation.
