HIPPA and collective bargaining agreement
Because the Collective Bargaining agreement negotiated between the NFL and it's players, along with the individual contracts that the players sign (the "standard player agreement") dictate that all players release their injury relevant HIPAA information.

So the patient isn't able to release his medical information to whoever he wants?

Yes the patient can release his own information. Not sure if initials of the other person is enough to be identifying information

So that teams can share info with other teams NOT with the media

It's not a game week dude. Are you suggesting that player record are public information year round?
And the medical information pertaining to injuries is released by the team and then reported by the media

What? Player injury reports are always given directly to the media immediately after injuries.

I was answering person's question above about injury reports.

Apparently the cause of action will most likely relate to a violation of the Florida privacy laws.

The investigation will begin with the hospital that generated the records. While some have cited HIPAA as the basis for a lawsuit against the hospital, HIPAA does not permit a private legal action for the violation of its terms. Instead, any claims against the hospital would be made under Florida privacy laws. Over the years, large verdicts have been awarded against health-care providers that released private patient information.

Correct. Schefter is protected by FL shield laws. Leaker is not.

Schefter is not protected from a hippa violation. He is the reason for the breach the same as the individual who snapped the picture.

Exactly correct volfan
A). The HIPAA violation involves whoever took the picture
B). P. Owens is the surgeon. The top pic is an OR schedule on an electronic medical record, the bottom is a printed OR schedule.

Pierre Paul loses 60 mill from Giants
Wins 100 mill in court.

Correct me if I am wrong, but I thought HIPAA was an oath taken only by those in the health care industry? I mean, if Joe Blow off the street walks in and somehow got the pic, he would be in a shite ton of legal trouble, but he didn't violate HIPAA because he never took that oath.

You're thinking of the oath physicians take, hipaa is law related to health care privacy
