Consciousness of guilt, as shown by the e-mail, would be evidence in a court of law that records were either maliciously deleted or intentionally not kept.
Given that they knew Congress was inquiring about this, it can certainly be grounds for Obstruction Of Justice charges at the least.

I had a friend work as a paralegal in an employment law firm and pretty much at every private company they worked with emails and Microsoft messenger texts were saved forever.
